A copy of this PCN has also been provided directly to Mr. Chad Coburn in the Wilmington Field Office. The project site is approximately ±14.45 acres and is located within the Landfall subdivision and is specifically located at 1909 Odyssey Drive, in Wilmington, New Hanover County (Latitude: 34.225992N; Longitude: - 77.816581 W. The project is located in the Cape Fear River basin and onsite waters drain to the ICWW. The Water Quality Classification for the ICWW is SA;HQW and the Stream Index Number is: 18-87-(23.5). The cataloging unit for the site is 0303001. Project History Ms. Jennifer Frye with the Corps of Engineers issued NWPs 12 and 27 for the proposed project on November 29, 2007 (AID #SAW-2003-00969), authorizing 0.059 acres of temporary wetland impacts. NWP 27 authorized 0.006 acres of temporary wetland impact for removal of an existing culvert to restore wetland function, and NWP 12 authorized the temporary wetland impacts from installation of utility lines. These permits expired on November 29, 2009. The original wetland delineation for the site was originally approved by Ms. Angie Pennock with the Corps of Engineers on August 20, 2003 (AID #SAW-2003-00969). This wetland approval expired in 2008. In 2008, Land Management Group re-evaluated the onsite wetlands and revised the wetland delineation, which was field reviewed and approved by Kim Garvey with the Corps of Engineers. Withers and Ravenel reviewed the wetland delineation in August 2010 and determined that the jurisdictional ditches previously flagged as wetlands were actually channelized streams. Withers and Ravenel revised the wetland delineation to designate onsite jurisdictional ditches as RPWs to comply with current regulatory guidelines. Copies of the final wetland survey have been included as an Appendix for Corps final verification and signature. Due to financial hardship as a result of the economy, the applicant never constructed the project or the authorized wetland impacts. The applicant wishes to proceed with the project as previously planned. The proposed impact locations have not changed, but the type of impact and acreage of impacts has changed as a result of the identification of RPWs. Proposed Impacts The project will require two permits. A NWP 12 is being requested for the proposed 21 If (182 sq ft) of temporary stream impacts and 0.047 acres of temporary wetland impacts. The 21 sq ft of temporary stream impacts (Impact B) and 0.047 acres of temporary wetland impacts (Impacts C, D and E) are needed for the subsurface installation of the water main and connection of the onsite sewer to an existing sewer line which runs through the project. Upon installation of the utility lines, the trench will be filled with the original excavated spoil and returned to natural grade. No additional fill will be placed in these areas. The disturbed areas will be seeded for temporary stabilization until natural recruitment stabilizes the area with native species. A NWP 27 is being requested for the remaining 11 sq ft of temporary stream impacts (Impact A) associated with the removal of two existing culverts within the stream that were installed during the construction of the sewer easement but were never removed. In the existing condition, the culverts are undersized for the amount of flow, as the channelized stream is located within a drainage easement. The undersized culverts result in water being temporarily impounded upstream of the culverts during a rain event. The removal of the culverts will create an open connection within the stream, providing unimpeded flow and hydrologic enhancement to downstream wetlands. Upon removal of the culverts, the area will be graded to match existing upstream and downstream contours, All disturbed areas will be seeded for stabilization according to the Sediment and Erosion Control Permit (NHC Grading Permit #86-07). In order to avoid permanent impacts, the project has been designed to construct two elevated bridges for wetland and stream crossings to provide vehicular access within the project. The applicant has utilized elevated vehicular bridges for the road crossings over the stream and wetlands to avoid permanent wetland impacts. There are also no proposed impacts for construction of the lots. The only proposed impacts are temporary, and are necessary to construction the water and sewer lines to service the proposed project. To prevent future impacts to onsite jurisdictional areas, the applicant proposes to preserve ±4.85 acres of post-development wetlands by incorporating Restrictive Covenant language into the HOA documents. A copy of the proposed Restrictive Covenant Language has been provided as an Appendix. The jurisdictional areas within the existing/proposed drainage and utility easements, foot bridge alignment and vehicular bridges alignment will not be included in the conservation area. These areas will be excluded from the conservation area to allow for construction and periodic maintenance which would be in direct conflict with the proposed Restrictive Covenant language. The Conservation Area Exhibit identifies the limits of the proposed conservation area, and will be recorded with the Restrictive Covenants. The Conservation Area Exhibit also identifies the jurisdictional areas within the easements that are not under conservation. The Conservation Area Exhibit has been notated to identify that any future activities within the easements resulting in impacts to jurisdictional wetlands and/or streams will require authorization from the Corps of Engineers prior to initiation of work, Access to Lot 24 will be provided through an elevated bridge driveway, which will be constructed by the purchaser of Lot 24. In order to provide assurance against future wetland impacts for access to Lot 24, the Conservation Area Exhibit has been notated in the Conservation Notes that access to Lot 24 will be provided by an elevated bridge not requiring wetland impacts. Since it is uncertain when the HOA documents will be drafted and recorded, a copy of the Restrictive Covenant language and Conservation Area Exhibit will be recorded with the New Hanover County Register of Deeds. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. C. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. No Waste, Spoil, Solids, or Fill of Any Kind No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-Construction Notification. SCHEDULE OF COMPLIANCE Curb outlet swales, vegetated areas and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational for their intended use prior to the construction of any built-upon surface, per the approved plans 2. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b. Sediment removal. C. Mowing, and revegetating of the side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Cleaning and repair of catch basin grates, flumes, piping, and the flow spreader mechanism. g. Maintenance of level spreaders. 4. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Project name change. C, Transfer of ownership. d. Redesign or addition to the approved amount of built-upon area or to the drainage area e. Further subdivision, acquisition or sale of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought. f. Filling in, piping, or altering any vegetative conveyance shown on the approved plan. 5. The Director may determine that other revisions to the project should require a modification to the permit. 6. The permittee is responsible for verifying that the proposed built-upon area does not exceed the allowable built-upon area. Once the lot transfer is complete, the built-upon area may not be revised without approval from the Division of Water Quality, and responsibility for meeting the built-upon area limit is transferred to the individual property owner. 7. The permittee must certify in writing that the project's stormwater controls, and impervious surfaces have been constructed within substantial intent of the approved plans and specifications. Any deviation from the approved plans must be noted on the Certification. The permittee shall submit the Certification to the Division within 30 days of completion of the project. 8. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. 9. Each lot in the subdivision covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all impervious areas and surface waters. Deed restrictions are incorporated into this permit by reference and must be recorded with the Office of the Register of Deeds prior to the sale of any lot. 11. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number 070652, as issued by the Division of Water Quality under NCAC 2H.1000. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. The permittee must submit a copy of the recorded deed restrictions within 30 days of the date of recording. 15. Prior to transfer of ownership, the swales must be inspected and determined to be in compliance with the permit. Any deficiencies will be repaired or replaced prior to the transfer. 16. The final plats for the project will be recorded showing all required Swale easements and common areas, in accordance with the approved plans. 111. GENERAL CONDITIONS 1. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. 2. The permit issued shall continue in force and effect until revoked or terminated. 3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 4.
