Subject: Exeter - Stallings Townhomes Development (SAW-2019-01285; DWR #20-0395)
This is a request to revise the locations of the 0.22 acres of wetlands impacts permitted under SAW-
2019-01285 and DWR #20-0395 due to revisions to the Grading and Drainage Plan based on agency
comments and requirements associated with permitting of the Construction Drawings for the overall
subdivision.
*All references described below to direction and location of features associated with this project are
made in relation to the Wetlands Impact Exhibit that is attached (for example PLAN-north refers to the
top of the exhibit)
The original Grading and Drainage Plan (and attached to the referenced permit), inadvertently left out
the outfall pipe from the two stormwater BMPs. The outfall pipe from the BMP in the PLAN-northwest
portion of the development creates an additional impact to install the flared end section and
associated rip rap. This permanent impact is approximately 0.01 acres.
This wetland impact for the PLAN-northwest BMP outfall pipe is required and cannot be avoided due
to the sizing of this BMP and the existing topography of the site associated with “daylighting” this
outfall pipe.
The PLAN-northwest BMP has been minimized as much as possible within the constraints of the site.
Constraints are floodplain & wetlands adjacent to North Fork Crooked Creek to the PLAN-west;
wetlands to the PLAN-south, a property line to the PLAN-north, and a new street to the PLAN-east.
As you can see in the plan layout, we have introduced a reverse curve into the proposed street to
provide the required surface area and volume storage of BMP and keep it out of the floodplain &
wetlands. We also introduced tall retaining walls (average height approximately 8-10 feet, with a
maximum height approximately 18.5 feet) on three (3) sides of this BMP to further minimize its
footprint and keep all grading associated with the dam side of the BMP outside the floodplain &
wetlands adjacent to North Fork Crooked Creek. Lastly, there is an existing Union County sanitary
sewer main and 30-foot easement on the PLAN-west side of the proposed BMP, parallel to the

Creek. The BMP outfall pipe needs to cross the easement and outfall on the opposite side of this
easement as to not outfall within the Union County sanitary sewer easement.
The PLAN-south BMP outfall does not create additional wetlands impact.
The previously shown sliver of permanent wetlands impacts (0.01 acre) along the PLAN-south side of
the property have been removed by regrading and proposing a retaining wall along, but outside, the
limits of the existing wetlands.
To offset the minor changes in grading along the limits of disturbance as the project progressed, we
have reduced the wetlands impacts made on the PLAN-southwest side of the project to keep total
permanent impacts at 0.22 acres as permitted.
Please refer to the attached exhibit for reference. Additionally, the Project Summary Sheet and Pre-
Construction Notification form are attached and have been revised per the requested changes.

The project area is currently residential properties, a maintained utility easement, and undeveloped forest land. Existing
land use in the vicinity of the project includes, commercial development, residential development, and undeveloped
forested/maintained properties.

The total length of all on-site streams is approximately 652 linear feet.

The purpose of the project is to construct a multi-family residential development on the subject property.
3e. Describe the overall project in detail, including the type of equipment to be used:
Development of the approximately 25-acre residential parcel will include separate multi-family residential buildings consisting
of 220 individual town-home units, a playground, associated parking lots, two (2) stormwater detention facilities, and site
access. Access into the site includes two private driveways; both connecting to Stallings Road.
The subject property currently is predominately residential properties, surrounded by residential and commercial
development. A maintained utility easement bisects the northern section of the subject property. The structures located on the
Site were identified as seven single-story residential buildings (three triplexes, one duplex, and three single-family homes),
five utility buildings, two storage barns, and one workshop. A gravel/dirt driveway and associated parking areas for residential
access are located on the subject property.
Kimley-Horn conducted a delineation of potential waters of the US on 17.5-acres of the overall 25-acre property on June 13,
2019. A field determination was conducted by the USACE on September 4, 2019, verifying the accuracy of the delineation.
Following the field determination, an approximately 8-acre additional adjacent property was purchased by the developer.
Kimley-Horn conducted a delineation of the additional property on September 4, 2019. No potential waters of the US were
identified on the additional property.

1.Avoidance and Minimization
Avoidance and minimization efforts were implemented during development planning and design to the greatest extent
practicable in order to reduce the overall impacts on the aquatic environment while staying within nationwide permit thresholds.
As previously mentioned, following the field determination, the developer purchased an adjacent 8-acre property. The
purchase of the additional property provided more flexibility to avoid/minimize impacts to jurisdictional features while
maximizing developable area. Through multiple iterations of site layouts which included as much as 0.5-acre of wetland
impacts, the project proposes to avoid and/or minimize impacts to approximately 2 acres of wetlands, 652 linear feet of stream
and 0.8 acres of open waters.

Temporary erosion and sediment control measures placed in jurisdictional areas will be removed and the original grade
restored upon completion of the project. A temporary seed mix will be applied immediately following construction to provide
initial stabilization.

The Stormwater Management Plan is designed to meet the Town of Stallings requirements which adopted the City of
Charlotte Stormwater Design Manual, BMP Design Standards Manual, and the Sediment & Erosion Control Ordinance. The
post-development flow rates have been reduced to the pre-development flow rates for both the 10-year, 6-hour storm event
and the 25-year, 6-hour storm event. The stormwater network has been designed to convey the 10-year storm event.

A data review was conducted using North Carolina Natural Heritage Program (NCNHP) Data Explorer on September 4,
2019, to determine the presence of any federally-listed, candidate endangered, threatened species, or critical habitat
located within the project area. Based on the NCNHP review, there are no records of federally-protected species within the
project limits or within a mile of the project site. A copy of the data review report is attached. Kimley-Horn conducted a
survey of listed species within areas of potentially suitable habitat on September 4, 2019. No individuals were observed. A
concurrence request has been submitted to USFWS Asheville office and is pending as of the date of this PCN submittal.
The concurrence response will be provided as soon as it is received.
