Box 350 Mineral Springs, NC 28108 Subject: 401 Water Quality Certification Hearhwood Subdivision Cabarrus County, NC Dear Sir or Madam: This Office has received information from the Cabarrus County Soil and Water Conservation District that you may be planning to disturb jurisdictional wetlands and/or 150+ linear feet of stream channel during construction of the subject development. Please be advised that pursuant to Army Corps of Engineers (ACOE) and North Carolina Division of Water Quality (the Division) regulations prior approval is required before initiating any activity that would disturb more than 150 linear feet of stream channel and/or 0.1 acre or more of wetlands. It should also be noted that it is the responsibility of the ACOE to determine whether or not any channel being impacted is indeed a stream for which they may claim jurisdiction. For jurisdictional channel impacts, compensatory mitigation may be required to replace unavoidable lost or degraded aquatic life uses of these streams, either through in-stream measures and/or riparian techniques such as buffer establishment or vegetative planting for temperature control (typically referred to as stream bio-engineering). In determining whether stream mitigation will be necessary, the Division will need to ascertain whether the stream supports aquatic activity. In order to obtain the Division's approval for any proposed stream and /or wetland impacts, seven (7) copies of the Pre-construction Notification Application (PCN) should be completed and returned along with supporting maps and documentation to the addresses listed in the application. Please make sure that-all maps submitted with the application are of suitable scale (e.g. V = 100') and delineate all impacted streams, ponds, and/or wetlands on the project site. You should also note that issuance of an ACOE 404 Permit or receipt of a written ACOE delineation verification does not relieve you of your responsibility of determining the need for a 401 Water Quality Certification from the Division of Water Quality prior to proceeding with any channel or wetland impacts.
