Consultants, Inc. (PEC) is requesting temporary suspension of NPDES Permit N° CO r'
NC0083810 for the referenced site. The subject site has been assigned a priority ranking
of 060E. The notice of ranking from the Mooresville Regional Office - Division of Water
Quality is enclosed for your reference. Per Senate Bill 1317, the requirement to cleanup
the release of from a petroleum UST has been temporarily suspended.
The groundwater remediation system, which discharged into an unnamed tributary of
Long Creek, was shutdown on Monday, July 22, 1996. GMOC asks for temporary
suspension of the NPDES Permit should cleanup is required at the site at a later date.

PERMIT
The permitted facility is a 0 . 0144 MGD groundwater treatment
facility consisting of an oil/water separator, an air stripping
unit (aeration tank) , and carbon filtration.
The current permit was issued on April 29 , 1994, effective
June 1, 1994, with an expiration date of September 30, 1996 .
Applications for permit renewal are required to be submitted no
later than 180 days prior to the expiration date.
RECORDS AND REPORTS
The operator keeps a log to document site visits, flow
measurements, and general activities . Records and reports are kept
at the office of Petroleum Equipment, Inc. , in Charlotte, North
Carolina. Records were not reviewed during this inspection.
FACILITY SITE REVIEW/OPERATIONS AND MAINTENANCE
All processes/units of the treatment plant were inspected and
appeared to be operating in an effective manner.
FLOW MEASUREMENT
Continuous flow is measured by a master flow meter. The flow
meter must be installed, calibrated and maintained to ensure that
the accuracy of the measurements are consistent with the accepted
capability of that type of device.
LABORATORY

The contract laboratory for this facility is HydroLogic Inc. ,
in Concord, North Carolina. Chronic Toxicity tests are performed
by Pace, Inc. , in Asheville, North Carolina. Neither laboratory
was evaluated during the inspection.
EFFLUENT/RECEIVING WATERS
The effluent on the day of inspection was clear without
visible solids or foam. The receiving stream did not appear
impacted by this discharge. Due to heavy rain during the
inspection the receiving stream was extremely muddy.

SELF-MONITORING PROGRAM
Self-monitoring data was reviewed for the period January 1995
through November 1995 . Toluene and Benzene are required to be
sampled upstream and downstream monthly. The samples were
collected and the laboratory data was submitted with the monthly
monitoring reports but was not submitted on an upstream/downstream
data sheet. Amended copies will be submitted. The facility is in
compliance with all other monitoring requirements .

Subject: Renewal of NPDES Permit No.NC0083810
Gaston County
Dear Permittee:
The subject permit expires on 960930. North Carolina General Stature 143.215.1(c) requires that an application for
permit renewal be filed at least 180 days prior to the expiration date. As of the date of this letter, the Division of
Environmental Management has not received an application for renewal. If continuation of the permit is desired,
failure to request renewal at least 180 days prior to expiration will result in a civil assessment of at least$250.00.
Larger penalties may be assessed depending upon the delinquency of the request.

If operation of a discharge or waste treatment facility is to occur after the expiration date of the permit,or if
continuation of the permit is desired,it must not be allowed to expire. Operation of the waste treatment works or
continuation of a discharge after the expiration date would constitute a violation of NCGS 143-215.1 and could result in
assessment of civil penalties of up to$10,000 per day.
A renewal application shall consist of the following information:
1. A letter requesting the renewal.
2. The completed application form (copy attached), signed and submitted in triplicate.
3. A processing fee(see attached schedule) in accordance with 15A NCAC 2H .0105(b). The application processing fee
is based on the design or permitted flow, whichever is appropriate.
4. Primary industries listed in Appendix A of Title 40 of the Code of Federal Regulations,Part 122 shall also submit a
priority pollutant analysis in accordance with Part 122.21.
5. Facilities which have not been constructed within the last permit cycle and are therefore, considered "new"
facilities, shall also submit an Engineering Alternatives Analysis, referenced in 15A NCAC Subchapter 2H .0103 and
Subchapter 2B .0201(c).
6. If the facility covered by this permit contains some type of treatment works,a narrative description of the sludge
management plan must be submitted with the application for renewal.
In addition to penalities referenced above,a permit renewal request received after the expiration date will be
considered as a new application and will require the higher application fee.
15A NCAC 2H.0105(b)(2)requires payment of an annual Administrative and Compliance Monitoring fee for most
permitted facilities. You will be billed separately for that fee (if applicable), after your permit is approved.

Dear Pearson:
A letter of request for an Authorization to Construct was received January 6, 1993 by the Division
and final plans and specifications for the subject project have been reviewed and found to be satisfactory.
Authorization is hereby granted for the construction of a groundwater treatment system consisting of an
oil/water separator, air stripping unit and carbon filtration with discharge of treated wastewater into an
unnamed tributary to Long Creek.
This Authorization to Construct is issued in accordance with Part III, Paragraph A of NPDES
Permit No. NC0083810 issued April 16, 1994, and shall be subject to revocation unless the wastewater
treatment facilities are constructed in accordance with the conditions and limitations specified in Permit No.
NC0083810.
The sludge generated from these treatment facilities must be disposed of in accordance with G.S.
143-215.1 and in a manner approved by the North Carolina Division of Environmental Management.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions,the Permittee shall take immediate corrective action,including those as may be required by this
Division, such as the construction of additional or replacement wastewater treatment or disposal facilities.
The Mooresville Regional Office,telephone number 704/663-1699, shall be notified at least forty-
eight (48) hours in advance of operation of the installed facilities so that an in-place inspection can be
made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00
a.m. until 5:00 p.m. on Monday through Friday,excluding State Holidays.
Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been installed in
accordance with the NPDES Permit, this Authorization to Construct and the approved plans and
specifications. Mail the Certification to the Permits and Engineering Unit, P.O. Box 29535, Raleigh,NC
27626-0535.
Upon classification of the facility by the Certification Commission, the Permittee shall employ a
certified wastewater treatment plant operator to be in responsible charge(ORC)of the wastewater treatment
facilities.The operator must hold a certificate of the type and grade at least equivalent to or greater than the

Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with
the conditions of Title 15A,Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at
least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and
must properly manage and document daily operation and maintenance of the facility and must comply with
all other conditions of Title 15A, Chapter 8A, .0202.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for the
life of the facility.
Failure to abide by the requirements contained in this Authorization to Construct may subject the
Permittee to an enforcement action by the Division of Environmental Management in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
The issuance of this Authorization to Construct does not preclude the Permittee from complying
with any and all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local,state, and federal) which have jurisdiction.

Dear Mr.Pearson:
This is to inform you that the Environmental Sciences Branch of the Division of Water Quality has not received
your quarterly toxicity monitoring report for the month of July 1996. This is in violation of Title 15 of the North Carolina
Administrative Code,Chapter 2,Subchapter 2B,Section.0506(a)(1)(A)which states,"monthly monitoring reports shall
be filed no later than 30 days after the end of the reporting period for which the report is made."
Dual reporting requirements exist for facilities which are required to conduct toxicity monitoring specified by
individual NPDES Permits. Facilities are required by the NPDES Permit to complete and submit an Aquatic Toxicity
(AT)Test Form to the Environmental Sciences Branch as well as report the results of all effluent test characteristics
(including toxicity)on a Discharge Monitoring Report Form(DMR)to the Division's Central Files.
To prevent further action,please submit this report by October 28, 1996, or notify this office of any problem
which may have prevented the report from being received on time. You will be considered noncompliant with the
reporting requirements contained in your NPDES Permit for the month of July until you make acceptable demonstration to
the Environmental Sciences Branch that the July 1996 AT report form was submitted to this office within the 30 day
reporting period. In addition,if within the next twelve(12)months,future reports are not received within the required
time frame,you may be assessed a civil penalty.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required,
you should complete the information block located at the top of the aquatic toxicity(AT)form indicating the facility name,
permit number,pipe number,county and the month/year of the subject report. You should also write"No Flow"on the
AT form,sign the form,and submit following normal procedures.
You may wish to consider submitting future toxicity test results via certified mail to the address located at the
bottom of this page to assist you in determining whether your toxicity test results were received on time by the
Environmental Sciences Branch.
Language present in your NPDES Permit specifies an increase in monitoring frequency to monthly upon any
single quarterly toxicity test failure. Please keep this in mind as the Environmental Sciences Branch will be expecting test
data after any single quarterly test failure. Upon passing,the monthly test requirement will revert to quarterly.
