PROJECT SUMMARY: The applicant is proposing to construct an 8-slip docking facility with boat lifts and new excavation for commercial use. Narrative Description: S The property is located at 1104 Salter Path Road (Lot #28) in Salter Path, Carteret County. The parcel is a 0.125-acre tract adjacent to Bogue Sound. This site is currently developed with a 2-slip docking facility, 64' of wooden bulkhead for shoreline stabilization, a storage building, gravel parking area, and upland retaining walls. The adjacent properties are residential. The average elevation of the high ground of the parcel is +5' above the normal high water level. Vegetation on this particular tract consists of some fringe upland grasses. This tract has approximately 74' of shoreline along Bogue Sound. Immediate offshore water depths range from about -0.5' to -3.0' normal low water (nlw). The subaqueous substrate is firm with shell. This waterbody is about 12,060 feet across at this location. These waters are not classified as a Primary Nursery Area and there is no submerged aquatic vegetation present. This area is closed to shellfish harvest and is classified as SA, High Quality Waters. There is not a Federal Channel in the immediate vicinity of the project area. However, there is a localized navigable slough approximately 150' offshore. 10. Proposed Development: The applicant wishes to replace the existing 2-slip docking facility with a new 8-slip docking facility for commercial use adjacent to Bogue Sound. The applicant also wishes to install boat lifts within the eight slips and dredge beneath the slips to the edge of the nearby navigable slough. The new access pier will be 4' wide and 82' long. It will leave from the existing bulkhead, oriented in a northerly direction. There will be four boat lifts on either side of this main access pier. Each lift will be 10' by 13' and able to support vessels up to 24' long. These slips will be supported by four finger piers. Each finger pier will be 2' wide and 24' long, at a 45-degree angle from the access pier. At the northern terminus of the main pier, there will be an 8' wide and 16' long "T" platform. New excavation of the shallow bottom area is proposed in order to support the ingress and egress of the docking vessels. Areas of excavation are proposed on either side of the docking facility to connect to the -3.0' nlw contour. These two areas of dredging will be within each boat slip, immediately adjacent to, and connecting to the edge of the local navigable slough. Each of these two areas will average 14' wide and 120' long. This will result in the removal of 181 cubic yards of benthic habitat. The existing gravel parking area incorporates the majority of the upland area of the lot. This will be utilized to support customer parking for the new docking facility. Anticipated Impacts: The docking facility will extend 90' waterward. Bogue Sound is approximately 12,000' across at this location. This will not pose a hazard to navigation as it will be approximately 60' landward of the nearest navigable slough. The docking facility will shade 648 square feet of Estuarine Waters and usurp 3,960 square feet of Public Trust Area. This 8-slip docking facility will have 320 square feet of platform area along 74' of shoreline. The new excavation will impact 6,024 square feet of shallow bottom habitat. The waters of Bogue Sound are classified as SA Waters and are not designated as a Primary Nursery Area. These waters are closed to the harvest of shellfish and there are no beds of submerged aquatic vegetation present in the immediate vicinity of the project area. The docking facility is approximately 60' away from a local channel. Gregson, Director MEMORANDUM DATE: September 16, 2010 TO: Doug Huggett THRU: Ted Tyndall FROM: Brad Connell' Resources Dee Freeman, Secretary SUBJECT: Comments and Recommendations - CAMA Major Permit - Charles Zwerling, Carteret County The following is my assessment and consequent recommendations of the above referenced proposal: This proposal involves the excavation of 6,024 square feet of shallow bottom habitat and the arrogation of 3,960 square feet of Public Trust Area. These waters of Bogue Sound are closed to shellfish harvest. This waterbody is not a Primary Nursery Area. This proposed 8-slip docking facility appears to meet the specific use standards listed in 15A NCAC 07H .0208 (b)(6). Assuming that state and federal agencies concur with the proposal, I recommend the project be authorized as proposed, contingent upon the following conditions: 1) In order to ensure compliance with the special conditions of this permit, an as- built survey showing the dimensions of the authorized structures, the neighboring riparian lines, and the normal low water depths shall be performed for the docking facility, and copies of the survey shall be provided to the Division of Coastal Management within 60 days of completion of construction; 2) Excavation will not exceed -3.0 feet below the normal low water level. In no case shall the depth of excavation exceed the depth of connecting waters; 3) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized; 4) All excavated materials will be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters; 5) No spoil material is to be placed within 30 feet of the normal high water line; 400 Commerce Avenue, Morehead City, North Carolina 28557 Phone: 252-808-2808 \ FAX: 252-247-3330 \ Internet: www.nccoastalmanagement.net An Equal Opportunity \ Affirmative Action Employer -50% Recycled \ 10% Post Consumer Paper Zwerling , September 16, 2010 Page 2 of 3 6) The docking facility will display a sign showing the location of the nearest pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier; 7) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure; 8) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification; 9) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge; 10)The authorized structure and associated activity must not cause an unacceptable interference with navigation; 11)The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party; 12)This permit authorizes a maximum of 8 boat slips. At no time shall more than 8 vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft; 13)Prior to construction of any new boat slips or other docking facilities under this permit, the permittee must apply for and receive an Easement from the Department of Administration's State Property Office as required under N.C.G.S. 146-12(e); 14)Any development or land disturbing activity that is considered non-water dependent is not authorized within 30 feet of the normal high water level unless specifically exempted by Coastal Resource Commission (CRC) regulations in place at the time of such development. Salter Path, NC 28575. Property Owner: Charles S. Zwerling, Agent: R. Douglas Guthrie and Contractor: J. Ryan Baysden are proposing the following work to be completed on site: -To remove the existing 8'x 16' T-Dock, 4'x 32' Pier and 2-Boatlifts. -To install NEW 8'x 16' T-Dock, 4'x 82' Pier, 4 - 2'x 24' Finger Piers and 8 - 45001b. Boatlifts. -Plumbing: I - Faucet per Finger Pier. -Electrical: I - Outlet per Boatlift. -Dredging: all Boatlifts and Access Channel to be dredged to 3' @ NLW (Approx. 180 yd^3). Spoils will be stored at Radio Island (described in MP-2). - There will be a minimum of 4 gravel parking spots on site. *Only in water soils will be disturbed. There are no restroom facilities, fuel or pump out services on site. The existing storage units are for rent and the slips will be sold/rented to the public for vessel storage only.
