REQUEST FOR MORE INFORMATION
Dear Sir or Madam:
On July 29, 2010, the Division of Water Quality (DWQ)received your application dated July 23,
2010, with Public Notice issued by the USACE on August 25, 2010, and received August 26,
2010, to fill or otherwise impact 3.9 acres of 404/wetland, to construct the proposed
commercial/retail development at the site. The DWQ has determined that your application was
incomplete and/or provided inaccurate information as discussed below. The DWQ will require
additional information in order to process your application to impact protected wetlands and/or
streams on the subject property. Therefore, unless we receive five copies of the additional
information requested below, we will place this project on hold as incomplete until we receive this
additional information. If we do not receive the requested information, your project will be
formally returned as incomplete. Please provide the following information so that we may
continue to review your project.
Additional Information Requested:
1. You do not appear to have avoided and minimized to the greatest extent practicable. In
"Conceptual Layout#4" (the preferred alternative)buildings A-F are located such that
wetlands must be filled. The elimination, reduction in size, or layout arrangement could
be changed to reduce the amount of wetland impacts.
2. The layout of the parking area in Phase II could be changed so as to reduce wetland
impacts. New Hanover County ordinance requires 1 space per 400 square feet of retail
area. The total area of these buildings is 127,900 square feet and 562 parking spaces are
proposed. Following the ordinance, only 320 parking spaces would be required for these
buildings. Please review your plans for the parking area to reduce impacts to wetlands.

3. Please explain why the area labeled as"Pond"in the northwestern corner could not be
moved further westward to maximize the use of uplands and minimize wetland impacts.
4. Please re-submit your site plans on full plan sheets at a scale of no smaller than 1"=50'
with topographic contours shown. Additionally, please indicate all wetland impacts
including fill slopes on the site plan and please locate all isolated or non-isolated
wetlands, streams, and other waters of the State as overlays on the site plan.
5. 7.8 acres of compensatory wetland mitigation is required for this project. Please provide
a compensatory mitigation plan. The plan must conform to the requirements of 15A
NCAC 2H .0500 and S131885, and must be appropriate to the type of impacts proposed.
Please address whether any private banks are available in this service area before EEP
payment is acceptable.
6. Please provide a copy of your referenced conservation easement/restrictive covenant.
7. Please discuss why parking decks and/or shared parking could not be utilized for this
project.
8. Please discuss why multilevel retail/commercial buildings could not be used for this
project.
Please submit this information within 30 calendar days of the date of this letter. If we do not
receive this requested information within 30 calendar days of the date of this letter, your project
will be withdrawn and you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands,
waters or protected buffers. Please be aware that any impacts requested within your application
are not authorized(at this time)by the DWQ. Please call Mr. Ian McMillan or Ms. Amy Chapman
