Dear Mr. Lastinger and Mr. Wojoski,
On behalf of Lennar Carolinas, LLC, McAdams is requesting a modification of the Individual Permit (IP) and Water
Quality Certification (WQC) for the Oak Pointe Residential Development. This 58-acre project is located on the south
side of Old Jenks Road, approximately 1,000 feet east of the intersection of Old Jenks Road and West Williams Street
in Apex, Wake County.
After the permit was issued, a sanitary sewer crossing, shown in Impact Area E from the original application (Original
Overall Impact Map and Impact Area E Exhibit attached), was changed to an aerial crossing to connect to the existing
sewer. The meander of the stream at the crossing location has increased dramatically in a short period of time after
construction. The picture below shows the stream erosion at the pier supporting the aerial SS line. McAdams has
developed the attached repair/stabilization plan (E1-E6) using a combination of non-natural armoring techniques
and natural channel design. The Town of Apex has reviewed this plan and requested expedited approval to prevent
a sanitary sewer line failure.

Modification of the IP and WQC are necessary to authorize an additional 95 LF of permanent stream impact and 841
SF of Zone 1 buffer impact (area of Zone 1 within limit of disturbance) to implement the stabilization plan. The
existing sanitary sewer easement will be utilized to access the repair area. A pre-filing meeting request was
submitted to DWR on October 29, 2020. At the end of the 30-day pre-filing meeting period, a check for modification
of the 401 Individual Water Quality Certification will be provided along with any other additional information
requested. As recent heavy rains have exacerbated the erosion, Lennar intends to proceed the with repair upon
approval from the USACE and will obtain a 401 modification after-the-fact once the pre-filing meeting requirement

Dear Mr. Walls:
Reference the Department of the Army (DA) permit issued on November 4, 2016, for the
permanent discharge of fill material into 0.95 acre of wetlands and 355 linear feet of stream
channel and temporary placement of fill material into 20 linear feet of stream channel for the
construction of the Oak Pointe residential subdivision in the town of apex, Wake County, North
Carolina. This modification requests additional permanent stream channel impact of 95 linear
feet at Impact area E for the installation of stream bank armoring/rip rap for the protection of a
sewer line crossing.
I have determined that the proposed project modifications described above are not
contrary to the public interest and are consistent with the 404 (B) (1) Guidelines and therefore,
the DA permit is hereby modified. The authorized work shall be completed in accordance with
the attached revised drawings. All other conditions of the original permit remain applicable and
the expiration date is unchanged. The permit modification is as follows:

CONSTRUCTION GUIDELINES:
1. ALL EROSION AND SEDIMENT CONTROL DEVICES SHOULD BE INSTALLED IN ACCORDANCE WITH THE APPROVED
EROSION CONTROL PLAN.
2. CHANNEL FLOW SHOULD BE DIVERTED AWAY FROM THE WORK AREA IN ACCORDANCE WITH THE APPROVED
EROSION CONTROL PLAN AND SITE SHOULD BE DEWATERED.
3. LOOSE MATERIAL AT THE TOE OF THE EMBANKMENT SHOULD BE EXCAVATED UNTIL A STABLE FOUNDATION IS

4. EXCAVATE THE STREAM BANK UNTIL A STABLE SLOPE ANGLE IS ACHIEVED. THE SUBGRADE SHOULD BE
SMOOTH, FIRM, AND FREE FROM PROTRUDING OBJECTS OR VOIDS THAT WOULD EFFECT THE PROPER
POSITIONING OF THE FIRST LAYER OF STONES AND FILTER FABRIC. REMOVE ROOTS, TWIGS, AND OTHER DEBRIS
IN BOULDER TOE EXCAVATION LIMITS.
S. PLACE NON WOVEN GEOTEXTILE FILTER FABRIC LOOSELY AND EVENLY ON PREPARED FILL SLOPE AND SECURE
WITH STAPLES 2 FEET ON -CENTER MAXIMUM. RETAIN A SUITABLE LENGTH OF NON WOVEN GEOTEXTILE
FABRIC TO CONTINUE 12" PAST THE FOOTER ROCK. ADJACENT STRIPS SHOULD OVERLAP 12 INCHES AND BE
STAPLED ON 12 INCH CENTERS. UPSTREAM OR UPSLOPE FILTER FABRIC SHOULD ALWAYS BE PLACED OVER THE
DOWNSTREAM OR DOWNSLOPE FILTER FABRIC. IF THE FILTER FABRIC IS TORN OR DAMAGED DURING
CONSTRUCTION, IT SHOULD BE REPAIRED OR REPLACED, STAPLES SHALL BE 0.125 INCHES DIAMETER NEW
STEEL WIRE FORMED INTO A "U" SHAPE NOT LESS THAN 6INCHES IN LENGTH WITH ATHROAT OF 1INCH
WIDTH.
6. FOOTER ROCKS SHALL BE PLACED INDIVIDUALLY AND KEYED INTO THE CHANNEL, BED, STREAM BANK AS
SHOWN IN THE DETAIL. THE TOP ROCKS OF THESE STRUCTURES SHALL BE PLACED LINEARLY, WITH TIGHT AND
CONTIGUOUS SURFACE CONTACT WITH ADJACENT ROCK. ENSURE THE ROCKS ARE STACKED SO THE PLACED
STONE RESTS ON TWO STONES IN THE TIER BELOW IT. HEADER BOULDERS SHOULD BE SET SLIGHTLY BACK
FROM FOOTER BOULDERS SUCH THAT PART OF THE HEADER BOULDER IS RESTING ON THE POROUS BACKFILL.
7. PLACEMENT OF COARSE BACKFILL SHOULD OCCUR CONCURRENTLY WITH THE PLACEMENT OF EACH
CONSECUTIVE ROCK LAYER. THE BACKFILL SLOPE ANGLE SHOULD BE 2H:1V OR FLATTER BUT SHOULD ALWAYS
