Plantation Brunswick County Land Resources Companies, LLC, Applicant Revised 3/7/07 Land Resources Companies, LLC proposes to construct a community boat ramp facility, temporary tie up dock, gazebo, parking, subdivision roads, bridge, and community boardwalk/platforms on their property, off of NC Highway 21 1, Supply, Brunswick County. The one road crossing and boat ramp impact a total of 0.169 acres of wetlands (0.019 riparian wetlands and 0.15 non-riparian). Land Management Group, Inc. has received confirmation of NC EEP's willingness to accept payments for the referenced impacts. The boat ramp facility will consist of a concrete boat ramp, gazebo, boardwalk and pier, floating dock for temporary boat tie-up, and a parking area. There will be two community boardwalks with 6' x 24' platforms terminating at the river's edge. The platforms will not extend over water. All community boardwalks crossing over wetlands will be a maximum of 6 feet wide and elevated an average of 3' above the marsh substrate. WITNESSETH: WHEREAS, Declarant is the developer of RiverSea Plantation, a subdivision located in Brunswick County, North Carolina ("Subdivision"); WHEREAS, Declarant subjected the Subdivision to the provisions of that certain Declaration of Covenants, Conditions, and Restrictions for RiverSea Plantation, dated April 13, 2004 and recorded on April 14, 2004 in Deed Book 1927, Page 143, Brunswick County-Register of Deeds, North Carolina records which was re-recorded on May 21, 2004 in Deed Book 1927, Page 143, Brunswick County-Register of Deeds, North Carolina records (as amended, the "Declaration"); WHEREAS, Subdivision contains wetlands, as more particularly described on Exhibit "A" attached hereto and incorporated by this reference ("Wetlands"), which are regulated by the United States Army Corps of Engineers ("Corps"); WHEREAS, the Corps requires that certain restrictions, covenants and conditions be imposed on the Wetlands to mitigate impacts to the waters of the United States; WHEREAS, pursuant to Article 14, Section 14.2(a) of the Declaration, until the expiration of the Development Period, Declarant may unilaterally amend the Declaration if such amendment is necessary to satisfy the requirements of any local, state or federal governmental agency; WHEREAS, the Development Period has not expired; and WHEREAS, the Declarant wishes to exercise its option to unilaterally amend the terms of the Declaration in order to satisfy the requirements of the Corps, a federal governmental agency. NOW THEREFORE, the Declarant hereby amends the Declaration as follows: 1. Section 10.16 is amended by adding the following new paragraphs to the end of that section: Except as provided in this Section 10.16 the following activities and uses are expressly prohibited or restricted in any area designated as "wetlands" or "marsh": (a) Industrial and Commercial Use. Industrial and commercial activities and any right of passage for such purposes are prohibited. (b) Residential Use. Except as expressly authorized by the Governing Documents, residential use in wetlands and marshes is prohibited. (c) Agricultural, Timber Harvesting and Grazing. Agricultural, timber harvesting, grazing and animal husbandry operations are prohibited. (d) Disturbance of Natural Features, Plants and Animals. 'There shall be no cutting, removal, mowing, harming, burning or destruction of trees, plants or other vegetation or the disturbance of natural features other than selective cutting and prescribed burning or clearing of vegetation for fire containment and protection, disease control, restoration of hydrology, wetlands enhancement and/or control of non-native plants, and as expressly authorized by the Governing Documents. (e) Construction of Buildings and Recreational Use. Except as expressly authorized in the Governing Documents, there shall be no constructing or placing of any building, mobile home, asphalt or concrete pavement, billboard or other advertising display, antenna, utility pole, tower, conduit, line, pier, landing, dock or any other temporary or permanent structure or facility on or above the wetlands or marsh. (f) Roads and Trails. Except as expressly authorized in the Governing Documents, there shall be no construction of roads, trails or walkways in any wetlands or marsh. (g) Mineral Use, Excavation, Dredging. There shall be no filling, excavation, dredging, 2 mining or drilling; no removal of topsoil, sand, gravel, rock, peat, minerals or other materials, and no change in the topography of any wetlands or marsh except as necessary for the purpose of combating erosion or incidental to any conservation management activities otherwise permitted in this Section 10.16 and as expressly authorized by the Governing Documents. (h) Wetlands and Water Quality. Except as authorized by any applicable permit, there shall be no pollution or alteration of water bodies and no activities that would be detrimental to water purity or that would alter natural water levels, drainage, sedimentation and/or flow in or over the wetlands or marsh or into any surface waters, or cause soil degradation or erosion nor diking, dredging, alteration, draining, filling or removal of wetlands, except activities to restore natural hydrology or wetlands enhancement as permitted by the State of North Carolina and any other appropriate authorities. (i) Dumping. Dumping of soil, trash, ashes, garbage, waste, abandoned vehicles, appliances or machinery or other materials on any wetlands or marsh is prohibited. (j) Enforcement and Remedies. The Army Corps of Engineers, its employees and agents and its successors and assigns, have the right to enter any wetlands or marsh at reasonable times for the purpose of inspecting the wetlands or marshes to determine whether the Declarant, the Members and their respective representatives or assigns are complying with the terms of this Section 10.16. Nothing in this Section 10.16 shall be construed to entitle the Army Corps of Engineers to bring any action against the Declarant or the Members for any injury or change in the marshes and wetlands resulting from causes beyond Declarant's or the Members' control, including, without limitation, fire, flood, storm or from any prudent action taken in good faith by Declarant or a Member under emergency conditions to prevent, abate or mitigate significant injury to life, damage to marshes or wetlands, or harm to the marshes and wetlands resulting from such causes. (k) In the event that a Member obtains a permit from the Army Corps of Engineers to construct a pier, dock or similar- improvement on such Member's L-ot and/or Common Area adjacent to such Member's Lot, such Member shall be granted a 10' wide construction easement over wetlands and/or marsh as necessary to construct such pier, dock or similar improvement consistent with the permit granted by the Army Corps of Engineers and any conditions applicable to such permit. 2. Except as modified hereinabove, the Declaration shall remain in full force and effect. The terms hereof shall be supplemental to the terms of the aforesaid Declaration and in the event of any inconsistency, the terms of the Declaration shall control. This Amendment shall be effective upon its filing for record in the Public Records of Brunswick County, North Carolina and shall be binding upon and inure to the benefit of all Owners of Lots in the Community and their respective heirs, executors, administrators, legal representatives, successors and assigns. 3.
