Re: Bath Branch Stream Valley Restoration Project

Dear Mr. Thomas:
As you know, the Bath Branch project involves a number of project components
including stream channel and valley restoration, three regional stormwater management
facilities, and repair/relocation of associated utilities. Most of our state and federal
permits were approved in late 2007. However, the North Carolina Department of
Environment and Natural Resources (NCDENR), Division of Land Resources, Dam
Safety Section withheld approval for the proposed Central District SWM Pond due to
concerns raised by the North Carolina Department of Transportation (NCDOT).
In particular, NCDOT was concerned about the embankment for the proposed Central
District SWM Pond encroaching on their rights-of-way along Route 52 and U.S.
Business Route 40. We have spent the last couple of years diligently working on a
redesign for the Central District SWM Pond that will address NCDOT's concerns while
still meeting the original objectives for the project as outlined by the Piedmont Triad
Research Park and the City of Winston-Salem.
The redesign is now complete and we anticipate final approval shortly. It is our intention
to submit the revised plans to you for your review and files. However, due to the
significant delay, we are concerned that our original Nationwide and WQ permits will
expire prior to the actual start of construction. There will be no additional impacts to
Waters of the U.S associated with the plan revisions. Therefore, we are here in
requesting an extension of our permits.
