Per the DWQ's Protocol for 401 Stormwater Management Plan Approval and Implementation, the stormwater management plan must be approved prior to the impact being conducted (you have met this benchmark). Then, the stormwater management plan must be implemented prior to the facilties being constructed and operational. For the specific wording, see Item (C) on the protocol document: httD://Dortal.ncdenr.ora/c/document librarv/Qet file?uuid=Oc509d61-6dd6-4da8-9342-7079fe478688&arouDId=38364 Therefore, it is permissible for you to do the earthwork for the Corporate Area at this point (provided that there is appropriate Sedimentation and Erosion Control). However, before the Corporate Area is occupied, the stormwater management plan that serves the runway areas must be constructed and operational (remember you did a swap - treatment of the runways in exchange for treating the Corporate Area). As a result, the airport may have additional funding to construct the Corporate Area. The Airport has requested me to determine if they could phase the construction to allow utilizing the current funding to its fullest. Currently, the Airport has funding for the Corporate Area mitigation and earthwork, but not the pavement and structures (and associated BMPs). No impervious surfaces would be constructed without stormwater controls. However, the airport would like to proceed with the mitigation and grading while funding is available. Would DWQ object to phasing the work in this manner? Thanks for your help on this.
