The property is currently forested. The surrounding area is comprised of residential homes and the nearby Town of Apex
parkland.

The purpose of the project is to construct an extension of the existing Milano Avenue to provide access through the
subject property.

The proposed project will include a small amount (less than 1/10th acre) of jurisdictional riparian wetland impact one
permanent, perennial stream crossing of an unnamed tributary (UT) to Beaver Creek for the proposed Milano Avenue
extension. Milano Avenue currently stubs at the eastern property boundary. The applicant requires the single stream
crossing to access useable upland portions of the property. Further, the Town of Apex requires that the roadway be
constructed to the limits of the western property line. Equipment typical of roadway projects, including backhoes, graders,
etc. will be used.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The applicant requested a detailed delineation of streams and wetlands prior to site plan development in order
to determine the extent and location of streams and wetlands in the vicinity of the proposed crossing. The site
plan has limited permanent impacts to one road crossing on a perennial/important stream. Streams are not
crossed multiple times by roads. The proposed road crossing is necessary in order to access useable upland
portions of the property for development. Further, the Town of Apex requires that the roadway be constructed to
the limits of the western property line. The project also proposes only 0.05 acres of riparian wetland impact. This
wetland impact is unavoidable due to the location of the existing Milano Avenue at the eastern property boundary.
The applicant cannot move the road to avoid the wetland impact without crossing onto neighboring properties and
existing home-sites or creating an unacceptable curvature radius to the roadway.
The applicant is also aware of the regional conditions associated with the Nationwide Permits 29. With respect
to residential development conditions (Regional Conditions section 4.9) the applicant does not anticipate any
impacts to streams or wetlands associated with stormwater facilities as there are none proposed, there are no
proposed single-family recreation facilities, there are no 100 year floodplain limits identified on this project and
therefore, there are no permanent wetland or stream fills proposed within the floodway and the stream
classification for this project is Water Supply (WS) IV; Nutrient Sensitive Waters (NSW) (i.e. not Outstanding
Resource Waters or High Quality Waters).
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Construction of the proposed piped impact will consist of by-pass storm piping to ensure constant flow within the stream
is maintained. Orange protective silt fencing will be placed outside of the impacted wetland corridor to ensure protection
of the non-impacted wetland. It is the intent of this plan for construction impact to take place during the dryer months of
the year.

The stormwater management plan has been submitted to Mr. Michael Deaton with
the Town of Apex for review and Approval. Mr. Deaton will not release final
Stormwater Management Plan (SMP) Approval for submission to the NC DWQ until
the NC DWQ approves the project. We are therefore requesting a conditional 401
Approval so that we may supply that to the Town of Apex in order to get the final
SMP Approval. Once we have the final SMP Approval, we will forward it to the
Central Office. We have included two (2) courtesy copies of the plans and

We have reviewed the "DRAFT Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated
Wetland Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft
states that most residential subdivisions are unlikely to cause cumulative impacts. This project does not meet any of the
three criteria of private projects that can clearly result in cumulative impacts. The proposed suburban in-fill development
is relatively small in nature, is within a residentially developed landscape bounded by existing home-sites and therefore,
the utility infrastructure (i.e. water and electricity) are already in place to service the proposed development. We
anticipate that you will advise us if a qualitative or quantitative impact analysis is required.
4. Sewage Disposal (DWQ Requirement)
4a. Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of wastewater generated from
the proposed project, or available capacity of the subject facility.
This project will connect to existing sewer lines. The Town of Apex will insure that the capacity of their treatment facility

The NC-Natural Heritage Programs Virtual Workroom was used to search for elemental occurrences of state and
federally protected species in the vicinity of the project. There were no elemental occurrences of federally threatened or
endangered species within 2 miles of the center of the project area.

The proposed project is in Apex, Wake County which is not near any coastal or tidal habitat that would support EFH (i.e.

Utilizing Google Earth and NC National Register Points, the closest structure is the Calvin Wray Lawrence House which is
4 miles from the center of the project. No structures were noticed during the wetland evaluation. The project is
consistent with adjacent land uses.
