PROJECT SUMMARY: The applicant proposes to perform maintenance excavation within the existing marina basin and access channel. Scotts Hill Marina Page 2 9. PROJECT DESCRIPTION: The project site is located at 2570 Scotts Hill Loop Road adjacent to a man-made basin along the Atlantic Intracoastal Waterway (AIWW) and Middle Sound, in Pender County. To locate the property from Market Street travel north on NC Highway17, turn right onto Scotts Hill Loop Road and travel east approximately 2.5 miles. The project site will be located on the right. Scotts Hill Marina is approximately 5.7 acres with approximately 1200 feet of shoreline frontage. The highground ranges from 1to 10 feet above mean sea level and the shoreline is stabilized with bulkhead. Existing manmade features on the project site include a concrete and gravel drive and parking lot, marina clubhouse, bulkhead, boat ramp, and floating and fixed dockage. The existing boat ramp is located at the western end of the boat basin and is approximately 40 feet wide. The existing marina has perimeter floating docks along the shoreline of the boat basin and floating dockage extending toward the AIWW. The marina currently provides dockage for 75 vessels. The applicant has stated that 4 slips adjacent to the boat ramp and 6 slips located on the outer "- head" floating dock are designated as transient slips and are not available for lease. The existing water depths within the boat basin range from approximately -2.5 feet to -5 feet at NLW (see Sheet 1 of 3). The existing boat basin ranges in width from 35 feet to 100 feet and extends into the highground approximately 400 feet. The entrance channel is located south of the existing floating dock and is approximately 60 feet wide and 350 feet long. The applicant has stated that shoaling is occurring on the south side of the boat basin where the shoreline has not been stabilized. The Scotts Hill Marina CAMA Major Permit # 196-84 was transferred to John Bradshaw on May 8, 1987. CAMA Major Permit #196-84 did not authorize excavation within the existing boat basin. However, CAMA General Permits #016792D, #017621D, and 6801D have been issued for maintenance excavation within the boat basin and entrance channel. The existing "L-head" floating dock is located approximately 200 feet from the edge of the federally maintained USACE Navigation Channel. The adjacent riparian properties to the north and south are developed single-family residences with docking facilities. There are no known archaeological resources within the project area. The Pender County Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Urban Growth Area. The waters of the AIWW and Middle Sound are classified SA-ORW by the Division of Water Quality. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. The open water of the AIWW and Middle Sound is approximately 650 feet wide at this location. 10. PROPOSED PROJECT: The applicant proposes to perform maintenance excavation within the existing marina basin and entrance channel. The dimensions of the proposed excavation would be irregular in width due to the oscillating shoreline within the bbat`basin and the adjacent wetlands south of the basin. The width of the dredge footprint would range from 30 feet to 100 feet. The total length of the basin and entrance channel would be approximately 750 feet. Excavation would be accomplished by barge mounted mechanical excavator. Excavated material would be placed on the barge for dewatering and then transported to an existing spoil island located to the Scotts Hill Marina Page 3 south of the project site at the confluence of the AIWW and Nixon's Creek. The proposed spoil location is a previously disturbed island consisting of approximately 0.8 acres. The applicant has stated that a single access point to the upland spoil area would be located at the deepest water access with a minimal amount of coastal marsh impact. The applicant has stated that timber/wetlands mats would be utilized to transport material across any wetlands. The existing access to the spoil island would require the applicant to transport material within the existing USACOE 1,000 foot AIWW Easement. The applicant has not proved any documentation authorizing the placement of spoil materials on this island and contends that the island has no ownership. No changes to the docking system or reconfiguration of the floating docks are proposed. 11. ANTICIPATED IMPACTS: The proposed dredging would result in the excavation of approximately 52,080 square feet of shallow bottom. The excavation of the basin by mechanical means will create steep side slopes and subsequent sloughing, thereby potentially increasing the top width dimensions of the proposed project. The applicant is proposing a 0.13% finished grade within the boat basin to promote flushing. Approximately 1,924 cubic yards of spoils material would be generated from the project and placed at an off-site spoil location. As proposed all spoil materials would be confined landward of any regularly or irregularly flooded marsh. Temporary impacts, approximately 150 square feet, to wetlands can be expected where timber/wetland mats are used to transport material. Short term increases in turbidity can be expected during dredging activity. The dredging will tie into existing 6' MLW allowing the boat basin to adequately flush. The basin will be dredged to a 0.13% grade. The perimeter of the maintenance dredging is within traditional use and previous dredging limits. Currently, the water depth ranges from 2' to 5' at NLW, which is causing difficulty with certain size boats that have traditionally docked at this marina. Most of the dredging will take place on the section that does not have a bulkhead. Some shoaling is taking place from the Southern property. Scotts Hill Marina has contacted Coastal Dredging to perform the dredging. Coastal Dredging's method of dredging is with an excavator and a barge. This will limit the impacts by not using hydraulic dredging. The dredged material will be hauled to an island located approximately 2.1 miles south of the site. The estimated amount of dredged material is 2,000 cubic yards. Unloading the dredged material has also been located on the attached disposal area maps. Wetland mats, approximately 50 feet, will be used in unloading the material at the disposal site. The disposal site does not show any ownership per New Hanover County GIS. There is clear evidence that spoils have been placed on this site in the past. We are requesting to use this site for disposal of the spoils. As shown in the USACE maps, this island is within their right-of way. However, the USACE does not show this as one of their approved disposal areas. Like similar other approved projects, we are requesting the USACE to allow us to utilize this site with the following conditions: The project must include measures to ensure that the disposal of the dredged material does not result in additional loss of marsh and include a plan to restore any marsh inadvertently impacted during the process of spoil disposal. Per this letter, I am offering the following as a special provision to the proposed project: A single access point to the upland scrub/shrub spoil area will be located at the deepest water access available with a minimal amount of coastal marsh impact. Timber/wetland mats will be utilized to access the upland spoil area, which will minimize the soil compaction and disturbance of the root mat. All work in ALe' p5_; 7 's t51f??; Page 2, Scotts Hill Marina Narrative Continue, coastal marsh will be conducted on the mats and they will be in place for the minimum amount of time required to unload the spoils. Although the root mat disturbance is not proposed or expected, the site will be monitored for natural re-vegetation. If restoration of the vegetation is not apparent after one growing season, Spartina Alternifloria will be transplanted from the adjacent marsh at 3 foot centers. Harvesting of native transplant will be conducted in a manner that will result in minimum impact to the native stand. The plant plugs will be planted in an upright position and planting holes will be dug large enough and deep enough to accommodate the entire root mass, preventing exposed roots. Soil will be packed firmly around the entire root mass to prevent air pockets and possible uprooting of the plants. Transplanting will be conducted during the optimal growing season for coastal marsh, between April 15 and May 15. Also, prior to beginning any dredge activities, the spoil disposal area shall be inspected and approved by the Division of Coastal Management. Cama will be contacted within 30 days of spoil disposal. This project will also be closely monitored by me and by Mr. Mason Herndon, Environmental Consultant of my staff. All work will be done in accordance with the plans and provisions. All wetlands will be delineated and fenced off appropriately. There will be no coastal wetlands impacted with the proposed dredging of this project. All dredging will be a minimum of 10' of any coastal wetlands. I, Chad Kimes, as a duly Registered Professional Engineer in the State of North Carolina, will be representing Scotts Hill Marina, and will personally oversee all of this proposed work.
