On behalf of our client,the Town of Wake Forest, Kimley-Horn is requesting a modification to the previously
approved Section 404 NWP 14 Permit(SAW-2017-02221)and Water Quality General Certification 4135
(DWR#09-0136 v7)due to changes in culvert design at the Wildflower Ridge crossing for the above
referenced project.As previously permitted,the project is proposing to construction Phase III of the Town of
Wake Forest's Dunn Creek Greenway,and this modification request relates to the spur trail connecting to
Wildflower Ridge Road in the northeast corner of the Project.
As detailed on the updated permit drawings and PCN Stream Impacts Table(see attached),the modifications
to the culvert design include the conversion of a headwall to a flared section of the culvert carrying stream S7
at the Wildflower Ridge crossing(Site 1). No changes to wetland, riparian buffer, or open water impacts will
result from the proposed modification to the project.The culvert modification has resulted in the following
impacts to stream S7 at Site 1:
•an increase of 12.31 LF of permanent stream impacts due to rip-rap stabilization
•an increase in 6 LF of permanent stream impacts due to the culvert extension
•a reduction of 18.31 LF of temporary stream impacts
As a result,the total mitigable permanent stream impacts have been increased by 6 LF to a new total of 155
LF of mitigable stream impacts. Consistent with the issued NWP 14 for the project,compensatory mitigation at
a 2:1 ratio has been proposed for the additional permanent stream impacts requested by this modification.A
revised letter is attached from NCDMS documenting acceptance for the new impact total for ILF mitigation
credit.

required to construct the greenway trail and install culverts and rip rap near permanent impact sites. All temporary impacts will
be returned to preconstruction contours and conditions upon completion of the project. Permanent impacts to streams S4, S9,
and S11 will result from the installation of new culverts under the greenway. Permanent impacts to streams S7 and S9 will
result from the extension of existing culverts. Compensatory mitigation has been proposed for all permanent stream impacts
resulting from new culverts or culvert extensions (155 linear feet). Permanent impacts to Dunn Creek, along with streams S7,
S9, and S11 will result from installation of rip rap stabilization for outlet protection, which will be keyed into the bank to ensure
no loss of waters results from the rip rap stabilization.

1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Impacts to streams, wetlands, and buffers within the corridor will be minimized to the extent practical throughout the
construction process by avoiding these features wherever possible. Where feasible, staging and construction access routes
will be located in upland areas. Temporary stream crossings will be protected with mud mats, wood bridgemats, or temporary
pipes and riprap, and will be restored to pre-construction conditions upon completion of the project. Temporary impacts to
riparian buffers will be re-planted and/or reseeded to restore vegetation after construction has ended. Additionally, tree
protection fencing, silt fencing, and other standard Best Management Practices (BMPs) and measures will be used throughout
the construction process to minimize impacts to downstream receiving waters and minimize runoff from the construction sites.

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in-
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved. You must also comply with all other state, federal or local government permits, regulations or
authorizations associated with the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will
expire. It is the applicant’s responsibility to send copies of the permits to DMS. Once DMS receives a copy
of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must
be made prior to conducting the authorized work. The amount of the in-lieu fee to be paid by an applicant is
calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation
required and assigned to DMS for this impact is determined by permitting agencies and may exceed the
impact amounts shown below.

Upon receipt of payment, DMS will take responsibility for providing the compensatory mitigation. The

On behalf of our client, the Town of Wake Forest, Kimley-Horn is
requesting a modification to the previously approved Section 404 NWP 14
Permit (SAW-2017-02221) and Water Quality General Certification 4135
(DWR# 09-0136 v7) due to changes in culvert design at the Wildflower
Ridge crossing for the above referenced project. As previously permitted,
the project is proposing to construction Phase III of the Town of Wake
Forest’s Dunn Creek Greenway, and this modification request relates to
the spur trail connecting to Wildflower Ridge Road in the northeast corner
of the Project.
As detailed on the updated permit drawings and PCN Stream Impacts Table
(see attached), the modifications to the culvert design include the
conversion of a headwall to a flared section of the culvert carrying stream
S7 at the Wildflower Ridge crossing (Site 1). No changes to wetland,
riparian buffer, or open water impacts will result from the proposed
modification to the project. The culvert modification has resulted in the
following impacts to stream S7 at Site 1:
• an increase of 12.31 LF of permanent stream impacts due to rip-rap
stabilization
• an increase in 6 LF of permanent stream impacts due to the culvert
extension
• a reduction of 18.31 LF of temporary stream impacts
As a result, the total mitigable permanent stream impacts have been
increased by 6 LF to a new total of 155 LF of mitigable stream impacts.
Consistent with the issued NWP 14 for the project, compensatory mitigation
at a 2:1 ratio has been proposed for the additional permanent stream
impacts requested by this modification. A revised letter is attached from
NCDMS documenting acceptance for the new impact total for ILF mitigation
credit.
