Dear Ms. Beckwith:
The North Carolina Department of Transportation (NCDOT) was issued previously a permit (SAW-
2007-1082-356) for construction of Sections B and C of SR 1521, Onion Mountain Road, in Macon
County. Prior to the issuance of this permit for the road construction project, we were issued a
permit (SAW-2006-40132-356) to install a 60-foot section of culvert and relocate 32 feet of channel
at a site where the stream flowed.across Onion Mountain Road. The U.S. Postal Service had
requested (hat we eliminate the stream from flowing across the road to facilitate mail delivery.
Approximately 47 feet of this culvert was installed on Onion Mountain Road under permit SAW-
2006-40132-356. A 20-foot section was installed under the roadway and 27 feet was installed
temporarily along a driveway; however, the channel change was not made at the time due to the
pending construction and realignment of the road. When this section of the road is constructed, the
pipe along the driveway will be removed and the pipe under the road will be re-installed and
extended to 60 feet. The construction project was started and a portion of the road was completed,
but work was not completed at twojurisdictional sites: The project had to be stopped due to a lack
of funding and the permits expired in June 2009 and March 2007 respectively. Funds are now
available to complete the previously permitted project. We are requesting reauthorization to
complete this work.
As per our phone conversation, f am submitting a new PCN, diagrams of the implct sites, a marked

t the originally permitted sites and photographs for sites 4 and 7. We propose to install new culverts
slightly below the existing streambed elevations where bedrock is not encountered to minimize
impacts to aquatic habitats and allow the existing stream gradients to remain as unchanged as

physically possible. Additionally, at site 4 the short section (38 feet) of stream that parallels the
existing road will need to be relocated to facilitate changing the road alignment.
The North Carolina Natural Heritage Database was checked for records of federally endangered or .
threatened species. There are no records of endangered or threatened species listed for the streams
to be impacted. Additionally, there are.no records for the Ellijay Creek watershed. The.Little
Tennessee River is designated critical habitat for the spolfin chub (Erionronax monacbn) and
Appalachian elktoe (Alasmidonlet rhveneliana); however, there are no records in the database for
the spotfin chub or Appalachian elktoe upstream of Lake Emory. This project is approximately 10
miles from the Little Tennessee River. Direct. impacts from culvert replacement in the small
tributaries should not be significant. For these reasons, we believe therenvill be "no effect" on
threatened and endangered species.
This project was reviewed previously for cultural resources. It was determined that there were no
historical properties or archaeological sites that were eligible for listing on the National Register.
The best management practices will be used to minimize and control sedimentation and erosion on
this project. The construction foreman will review all erosion control measures daily to ensure
sedimentation and erosion is being controlled effectively. If the planned devices are not functioning
as intended, they will be replaced immediately with better devices. The rock silt screens and other
erosion control devices will be in place prior to pipe culvert construction and will remain in place
until the project is stabilized.
Impacts to Waters of the United States
The streams to be impacted for this.project are small and have limited flow. The streams appear to
be perennial and have substrates composed primarily of gravel, sand or silt. The unnamed tributary
at site 4 is not shown on the USES 'topographic map. This stream flows approximately.1000 feet to
an unnamed tributary to Laurel Creek that is shown on the USGS topographic map as perennial.
This stream then flows approximately 1600 feet to Laurel Creek. The unnamed tributary at site 7 is
shown on the USGS topographic map as perennial; it flows approximately 200 feet downstream
where it meets the same unnamed tributary that site 4 flows into. This unnamed tributary flows
approximately 4500 feet to Laurel Creek. Laurel Creek then flows approximately one mile to
Ellijay Creek. Ellijay Creek then flows approximately 3.5 miles to the Cullasaja River. The
Cullasaja River meets the definition of a Traditional Navigable Water. For these reasons, we
believe these small unnamed tributaries are Relative Permanent Waters that are under the
jurisdiction of the U.S. Army Corps of Engineers. In order to complete construction of this project
in accordance with our current secondary road standards, it will be necessary to impact waters of the
United States in the Little Tennessee River Basin. Specifically, a charnel needs to be relocated, one
section of culvert removed and a remaining section of culvert installed at site 4. A culvert steeds to
be replaced and extended at site 7. The culverts at sites 1-3 and 5-6. that were permitted previously
have been installed. The impacts are listed in the table below.

with the construction project outlined above. By copy of this letter; 1 am asking Mr. David
McHenry, Mountain Region Coordinator, of the North Carolina Wildlife Resources Commission
(NCWRC) to comment directly to you concerning the 404 Nationwide Permit request.
Also, by copy of this letter, I am requesting authorization tinder Section 401 of the Clean Water Act
from the North Carolina Department of Environment and Natural Resources (DENR), Division of
Water Quality (DWQ). In addition, I am asking Mr. McHenry and Mr. Ed Ingle, Roadside
Environmental Field Operations Engineer (NCDOT), to comment directly to me concerning this
permit request.

The road is a narrow rural road along a mountain ridge. Land use is primarily rural residential and landcover is primarily
forested with some open pasture land. There are several gated communities but mostly single family residential.

The project Involves widening the rural road to secondary road standards and paving to provide a safer and better
maintained roadway.

The remainder of the road to be constructed under this permit is approximately 2800 feet. The road will be widened,
graded, drained, and paved. Track hoes, bulldozers, dump trucks, various hand tools, pumps and diversion pipe will be
used to accomplish the work.

A permit (SAW 2006-40132-356 and DWQ Project No. 061175) was Issued on August 1, 2006 for 60 foot of pipe and to
relocate 32 feet of stream channel. Thr US Postal Service requested a repair where the stream was running across the
roadway. Approximately, 47 feet of pipe was Installed, 20 feet under Onion Mountain Road and 27 feet as a temporary
measure along an adjacent driveway. The channel was not relocated. Subsequently, we were issued a permit (SAW-
2007-1082-356 and DWQ Project No. 070487) for construction of Onion Mountain Road Sections B & C. Funds ran out
before the construction work was completed. The work at Site 4 where the stream relocation is needed and at site 7 near
the end of the project require additional work within jurisdictional areas.

The project is not a new road but the widening and paving of an existing secondary road. The area primarily is rural
single family residential. Steep terrain and USFS lands will limit development is some areas. Several gated communities
are In the process of development; however, these were In process prior to the road project.
