Dorney - rSEM?t K QO Lf Y 1 JET SANDS ANrJ 5T(?Rt A' F.k t?%.hl Cn By a letter dated January 31, 2006 Duke Energy Carolinas, LLC (Duke) filed a 401 Water Quality Certification (401 WQC) application with the North Carolina Division of Water Quality (NCDWQ) for the Nantahala Proiect. Duke requested that NCDWQ place a hold on processing the 401 WQC application for the Nantahala Project until the final disposition of the Dillsboro Hydroelectric Project No 2602 is resolved with bath the NCDWQ and the Federal Energy Regulatory Commission (FERC). The license surrender application for the Dillsboro Project was filed with FERC on May 28,21-004. By letter dated December 12, 2006, Duke requested that NCDWQ use the data contained in the application submitted with the January 31; 2006 letter for processing the new 401 WQC application to NCDWQ for the Nantahala Project. Since the one-year timeframe that FERC allows states to process 401 WQC applications expires on December 12, 2007 for the Nantahala Project, Duke hereby withdraws the previous 401 WQC application letter that was filed and stamped received with NCDWQ www. duke-energy. com on December 13, 2006 and is simultaneously requesting that NCDWQ use the data contained in the application submitted with the January 31, 2006 letter to NCDWQ for processing the new 401 WQC application for the Nantahala Project. Enclosed is the application fee of $475. At this time, Duke is also requesting that the NCDWQ place a hold on the processing of the Nantahala Project 401 WQC application. Duke is requesting this hold because final disposition of the Dillsboro Project is an important consideration in the Nantahala Cooperative Stakeholder Team Settlement Agreement (which also addresses the Nantahala Project) and regulatory approvals related to the Dillsboro Project are not fully resolved, including (1) the FERC has not yet responded to Duke's requested rehearing of the FERC's order dated July 19, 2007 that approved the license surrender and removal of the Dillsboro Project and (2) Duke is still considering if it will accept the 401 WQC that NCDWQ issued in November 2007 for the Dillsboro Project.
