All, Beth Miratsky has withdrawn her request for Department of Army authorization to conduct stream bank stabilization on the Tuckasegee River (see below). The site is at 1465 Hyatt Creek Road in Ela, Swain County, NC. The coordinates are 35.45217 N, 83.39732 W. Per Ms. Miratsky's statement, the Corps is withdrawing her request for utilization of NWP 13. Therefore, the Corps is ending its request for coordination/consultation under ESA Section 7 with FWS and under NHPA Section 106 with SHPO and THPOs for this project. Corps Action ID SAW-2015-02114. Your proposed streambank stabilization project will require a 401 Water Quality Certification. The application review fee is to process the 401 Water Quality Certification request. Once the fee is submitted, it will not be refunded. You have two options with regard to submittal of the review fee: 1. You may pay the fee and DWR will begin our review of the application. Our regulatory jurisdiction does not include cultural/archeological resources. If you've satisfied DWR's requirements, we can issue a 401 Water Quality Certification approval regardless of the results of the cultural/archeological resource evaluation. However, you would still need the US Army Corps of Engineers' (USACE) approval to proceed with the project. You may wait to pay the fee until the USACE's cultural/archeological resource request is adequately addressed. Until the fee is paid, your project will remain on hold with DWR.
