Mr. Chambers and Mr. Cohen,
As a follow up to yesterday's meeting, the Corps understands that you propose to provide on-site preservation
as a component of your project. Please find the attached preservation models. I believe that the Declaration of
Restrictions/Conservation Declaration will be the most applicable, so I took the liberty of highlighting the
sections that you all will need to fill in - see second attachment. As discussed, please email a draft survey and
document to us to review prior to any recordation.
Also, based on our meeting, it is my understanding that you will provide the Corps with some additional
information regarding your alternatives analysis, i.e. location of the road.
I know one of your big concerns is any compensatory mitigation requirements. As I explained, the Corps must
first evaluate your efforts to avoid and minimize direct and indirect impacts to the aquatic resources. Providing
a legal mechanism for preserving remaining waters and upland buffers adjacent to those waters is key to your
minimization. Next, the Corps must evaluate the impacted resource (in this case, two tributaries). I have
received the requested information (stream data) from Mr. Homans and will review as soon as possible.
Once we review the stream data, receive the draft preservation documents and road alternative information, we
will inform you of our decision regarding compensatory mitigation.
