Hello Alan:
This is a request for 401 WQ Cert. corresponding to NW 14. It is an after the fact for an
unauthorized culvert extension. The submittal included a State Stormwater Permit issued
for the School along with the O & M Agreements for the BMPs. My comments are:
(1) If the 401 will be issued for only for the culvert extension activity and not the
entire school project, then the 401 does not need SMP approval.
OR
(2) If the 401 is to be issued such that the project area is defined to include the school,
then please write an additional information letter to request for the approved
Stormwater Management Plans (full size plans and design calculations) from the
applicant or you may issue the 401 and include it as a SMP condition that they
send us the approved plans. We already have the State Stormwater Permit and
Operation and Maintenance Agreements so we will need full size plans and
design calculations for the stormwater management practices.
So the boundary of the project area for the requested 401 as determined by the Corps will
determine if we need the approved SMP. If you have any questions, please let me know.
