If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Facility consists of an extended air package plant with clarifier and sludge return, effluent chlorination and dechlorination permitted to discharge up to 0.007 MGD. DMR data from the past 12 months show BOD and TSR violations in May of 1995. Otherwise region states that the plant is operating well, based on several site visits. As a result of concerns about flow variations, the pervious permit was modified (effective August 15, 1995) by DEM letter dated June 15,1995 to require continuous flow monitoring and composite sampling for BOD, TSR and NH3. The regional staff report states that a water meter was installed and flows are recorded daily, but a composite sampler was not. The region feels confident that grab samples will be representative of the discharge and the requirement for a composite sampling will be dropped. Frazier (ARO) also mentioned in her staff report that a conventional septic tank /sand filter system may be installed to treat lower flows. This permit will be kept for future growth opportunities. House of Representatives Legislative Building -Room Raleigh, NC 27603 2217 Dear Representative Ramsey: 09W HNF=1 Subject: English Wolf Lodge Madison County This letter is to confirm our recent discussions concerning the status of wastewater treatment facilities serving the English Wolf Lodge (also known as the Wolf Laurel Inn). English Wolf Lodge is a 40 unit motel/inn which is owned by Mr. Orvelle English. The Lodge is served by a 7,000 gallon per day wastewater treatment facility that discharges into Wolf Laurel Branch, a Class C Trout Water stream. As you may recall, we classify wastewater treatment facilities according to their size and complexity. The facility serving the Lodge is classified Class II. The treatment facilities serving the Lodge were initially constructed without first obtaining authorization from the Division of Environmental Management (now the Division of Water Quality). Our Asheville Regional Office staff worked with the owners of the facility to secure the necessary approvals to operate the facility. A few years ago, in reviewing self -monitoring reports submitted by the facility, we confirmed that the operator in responsible charge of the facility had falsified the data on the monitoring reports. The operator resigned and voluntarily surrendered his operators certification. P.O. Mr. English has regularly voiced his objections to the self -monitoring requirements and their associated costs. However, monitoring and reporting requirements for the Wolf Laurel Lodge are consistent with those assigned to other Class II facilities across the state. Division staff are currently working on a renewal of the NPDES Permit for this facility, and it is expected that the new permit will incorporate an increase in monitoring frequency from twice per month to weekly for certain waste parameters (Biochemical Oxygen Demand, Total Suspended Solids, pH, Fecal Coliform, and Ammonia). We have encouraged the owners to explore elimination of the surface water discharge in favor of a land -based disposal option. Based on recent conversations with the Asheville Regional Office staff, it is my understanding that the owners are currently pursuing approval of a septic tank system for disposal of the wastewater. The owners have purchased land adjacent to the Lodge and have received preliminary approval of the site from the Madison County Health Department. Construction of a septic tank system will eliminate the necessity for discharge of the wastewater, and thus eliminate a significant amount of the ongoing operation and maintenance costs. I have discussed the monitoring requirements for the facility with our Asheville staff, and have decided that the Division will not increase the monitoring requirements in the permit (from 2/month to weekly) that is up for renewal so long as Mr. English continues to aggressively pursue elimination of the discharge. Other: none PART IV - EVALUATION AND RECOMMENDATIONS * I spoke with both Mr. Orville English and the sanitarian supervisor, Mr. Ronnie Ledford, this week about the installation of conventional ground absorption system. Mr. Orville English is in the process of obtaining property adjacent to the Lodge property and will be installing a 2,000 gpd conventional septic tank - sand filter system to treat the wastewater, since the wwtp flows arel,,so low. He wishes to maintain the NPDES permit and WWTP in the event that his business and flows increase. * It is recommended that the permit be issued with the deletion of the composite sample requirement. * In addition, it is recommended that there be two limits pages issued. 1) One, which will require twice a month monitoring for BOD, TSS, fecal coliform and ammonia when flows are < or = 2,000 gallons per day. 21 The other, which will require weekly monitoring for those same parameters when flows are between > 21000 and 7,000 gallons per day. * This is a class II facility which requires a daily visit by the operator. The draft permit changed the temperature monitoring requirement from weekly to daily. The data obtained from monitoring temperature daily is of no value to DEM nor the operator, since there is nothing that the permittee or operator can do about this. The draft permit also changed the total residual chlorine monitoring requirement from daily to twice a week. It would be more beneficial to increase the TRC monitoring requirement instead of decreasing it and to decrease the temperature monitoring instead of increasing it. Therefore, it is recommended that TRC monitoring be required daily andl,ithe temperature monitoring be required weekly. * In addition, the 2B.0500 regs should also be changed to require daily TRC and weekly temperature at class II facilities. Since these facilities require a daily operator visit, it would -3- be prudent to require monitoring that has the potential to protect water quality, rather than daily monitoring a parameter for which the operator or permittee has no control. * Per your request, it is verified that the only other discharger to the Wolf Laurel Branch is Carolina Water Service's plant which serves Blue Mountain Golf and Country Club (NC0076431), formerly known as Walnut Mountain Ventures. The drawing attached to the stream -lined renewal package indicated that there was another discharger, namely, Wolf Laurel Ski Resort at flows of 0.03 MGD. This appears to be in error, as the ski resort is on a conventional ground absorption system.
