Description of projects area and activity: This authorization is for the temporary discharge of clean fill material associated with the removal of accumulated sediment from both the upstream and downstream end of a single culvert as follows: 1) 80 linear feet of temporary impacts on the upstream portion of the culvert; 2) 50 linear feet of temporary impacts on the downstream portion of the culvert. These temporary impacts include cofferdams associated with the activity and the discharge of rip rap at both the upstream (80 linear feet) and the downstream (50 linear feet) portions of the culvert. The proiect must be conducted in accordance with the application and drawinl4s submitted on July 16, 2010. Applicable Law: ® Section 404 (Clean Water Act, 33 USC 1344) ? Section 10 (Rivers and Harbors Act, 33 USC 403) Authorization: Regional General Permit Number: Nationwide Permit Number: 3 Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached conditions and your submitted plans. Any violation of the attached conditions or deviation from your submitted plans may subject the permittee to a stop work order, a restoration order and/or appropriate legal action. This verification is valid until the NWP is modified, reissued, or revoked. All of the existing NWPs are scheduled to be modified, reissued, or revoked prior to March 18, 2012. It is incumbent upon you to remain informed of changes to the NWPs. We will issue a public notice when the NWPs are reissued. Furthermore, if you commence or are under contract to commence this activity before the date that the relevant nationwide permit is modified or revoked, you will have twelve (12) months from the date of the modification or revocation of the NWP to complete the activity under the present terms and conditions of this nationwide permit. Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You should contact the NC Division of Water Quality (telephone (919) 733-1786) to determine Section 401 requirements. For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (LAMA), prior to beginning work you must contact the N.C. Division of Coastal Management. This Department of the Army verification does not relieve the permittee of the responsibility to obtain any other required Federal, State or local approvals/permits. Action ID ' Basis of Jurisdictional Determination: The stream, identified as Booker Creek, is a relatively permanent water (RPW), and a tributary to Little Creek, which is an RPW. Little Creek is a tributarv to Jordan Lake, a traditionally navigable water (TNW) and an impoundment of the Haw River, a TNW. The Haw River is a tributary to the Cape Fear River, a navigable water of the United States. The Ordinary High Water Mark (OHWM) of Booker Creek was indicated by the following physical characteristics: clear natural line impressed on the bank shelving and the destruction of terrestrial vegetation This jurisdictional determination is only for the waters proposed for impacts associated with this Nationwide Permit verification and does not include any other waters/wetlands that may be located on the property or project site Appeals Information (This information applies only to approved jurisdictional determinations.)
