Subject: Ballinger Road Bridge Replacement in Guilford County, TIP B-4695.

The NC Division of Water Quality has reviewed your submittal for a 401 Water Quality Certification and
Jordan Buffer Rules for the aforementioned project. Review of your application revealed it lacking
necessary information required for making an informed permit decision. The permit application was
deficient in the following areas:
• For the purposes of the Table of Uses in the Jordan Buffer Rules, the bridge crossing is considered a
crossing only within the area between the end bents, all other impacts to Horsepen Creek and the UT
are considered parallel impacts. Please delineate parallel buffer impacts to Horsepen Creek and the
UT to Horsepen Creek (Stream A) for roadway approaches separately on your permit drawings, and
provide approval of associated mitigation for the parallel impacts.
• Fill out the buffer impact table, separating out the impacts from the roadway approaches, bridge,
walking trail (separate from sidewalk), and utility impacts
• Show the walking trail on plans and associated buffer impacts that are beyond those impacts
necessary for the bridge/road.
• Explain why fill slopes cannot be further reduced to 1.5:1 to further avoid parallel buffer impacts
• Provide a plan and profile for the relocated stream. Although this is not a natural channel design, the
Division needs enough detail to ensure the proper dimensions will be constructed and that grade
controls are included if necessary.
• Show a proposal for shifting road to the other side, including an overlay of impacts to the mitigation
site
• Include NCDOT as the owner of the road, if they currently and will continue to own the road
Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold
until we are supplied the necessary information. You have 30 days to respond in writing with the
requested information or notification to this office that the information is forthcoming. If, at the end of
the 30 days, this office has not received this information in writing, we will assume you are withdrawing
your application and it will be returned. Furthermore, until the information is received by the NC
Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place
the permit application on hold.
