To enable us to complete our review in accordance with N.C.G.S. 143-215.1 and 15A NCAC 2H.0105, please provide additional or revised information to address the following comments: 1. Incomplete Engineering Alternatives Analysis (EAA): The Division requires applicants to fully document and exhaust all alternatives to surface water discharge (G.S. § 143-215.1(b)(a) and 15A NCAC 2H.0105 (c)(2)). Please evaluate the feasibility of the following alternatives: connection to a municipal or regional sewer collection system; rehabilitation of the land where the current system resides; land application, including onsite subsurface systems, drip irrigation and spray irrigation; water reuse, in which all or a portion of the waste water generated is reused; direct discharge to surface waters; or a combination of alternatives that would minimize or eliminate the direct discharge alternative. Economic feasibility should include analysis of capital costs, recurring costs, and lost opportunity costs. The message attached in the application from the engineering representative indicated that the Buck Creek area is not currently serviced by any public sewer system, an analysis prepared by a soil scientist stated that subsurface onsite systems (including aerobic drip irrigation) are not feasible, and the Macon County Public Health Department denied an improvement permit as the site was deemed unsuitable for a ground absorption sewage system. 2. Information for a 7Q10 was provided with the application. Please provide additional information for a 30Q2 to inform on low flow conditions at the site. 3. The application states that the residence contains two bedrooms. Based on a review of property records by the Asheville Regional Office, the residence contains three bedrooms. Please confirm the number of bedrooms in the residence. This Cover Letter is intended to provide a narrative description of the project and serve as the request for the Authorization to Construct. Project Description The Owners have recently made their residence at 147 Teague Estates Road in Macon County their permanent home. The residence is an old log cabin structure which they are renovating. They currently have an existing septic permit for a two bedroom house, but they have been issued a Notice of Violation from the County Health Department as the drainfield was damaged when they tried to repair some site surface drainage. They are expanding the square footage of the house but it will remain a two bedroom home. The Owners have attempted to find other land application options, but the site is extremely limited as it is right on the bank of Buck Creek and the underlying ground appears to be comprised of river cobble/fill. As they can not locate the existing septic tank, it has not been pumped. Alternatives Feasibillj a) The Buck Creek area of Macon County is not served by any public sewer system. It is approximately two miles to the intersection of Buck Creek Road Highlands Highway. b) A Septic System Rejection Letter from the Macon County Environmental Health Department for a repair septic permit is provided as Attachment A. Also provided is the Notice of Violation for the existing system. c) A drip or spray irrigation system has greater area requirements than a subsurface drip system due to setback requirements. Provided as Attachment B is a letter from a NC Licensed Soil Scientist that the site is unsuitable for any type of subsurface system (including drip) due to space limitations. Therefore a surface spray or drip system would also be unsuitable due to limited space. Receiving Waters The receiving water is Buck Creek, a Class C Trout Stream. The 7Q10 report from the USGS is provided as Attachment C. Approximate Lat/Long of the discharge location would be 35.124/-83.259. Additional Requirements This application is being submitted by the consulting engineer representing Ms. Woodside as her Authorized Representative. A letter authorizing this is provided in Attachment D. Enclosed with this Cover Letter are three sets of sealed plans and specifications and a fee check for $60. According to your application the site ishto serve a proposed inbedroom home with a design wastewater flow of 240 gallons per day. The accordance with the laws and rules governing wastewater systems in North Carolina General Statute 130A-333 including related statutes and Title 15A, Subchapter 18A, of the North Carolina Administrative Code, Rule .1900 and related rules. Based on the criteria set out in Title 15A, Subchapter 18A, of the North Carolina Administrative Code, Rules .1940 through .1948, the evaluation indicated that the site is UNSUITABLE for a ground absorption sewage system. However, the Health Department has determined that none of the above options will overcome the severe conditions on this site. A possible option might be a system designed to dispose of sewage to another area of suitable soil or off -site to additional property. For the reasons set out above, the property is currently classified UNSUITABLE, and no improvement permit shall be issued for site in accordance with Rule .1948(c). However, the site classified as UNSUITABLE may be classified as PROVISIONALLY SUITABLE if written documentation is provided that meets the requirements of Rule .1948(d). A copy of this rule is enclosed. You may hire a consultant to assist you if you wish to try to develop a plan under which your site could be reclassified as PROVISIONALLY SUITABLE. You have a right to a formal appeal of this decision. This evaluation was conducted to determine the potential of a 0.42 acre parcel to utilize an onsite subsurface septic system for a 2-bedroom house (240 gallons per day). The site has an existing 2-bedroom house (with existing septic system), however a 3 car garage with expanded master bedroom addition is being proposed. The final bedroom count will remain 2-bedroom. The property was evaluated in accordance with North Carolina statutes for waste disposal Systems ("Laws and Rules for Sewage Treatment and Disposal Systems", (amended October 2011)) as part of the planning process to evaluate areas of soil with potential for subsurface wastewater treatment and disposal. Licensed Soil Scientist (Certification # 1254) SITE HISTORY AND PHYSICAL CHARACTERISTICS The subject property is located off of Teague Estates Road in Cullasaja (Macon County). The site borders Buck Creek. Site vegetation consists predominately of rhodendron vegetation and rock outcrops. An existing (2 bedroom) home is located on the property. An existing septic tank and drainfield accommodate this house. According to County notes this system was installed in 1975. The drainfield showed no evidence of failure, however it was noted from the County that the existing drainfield is currently being driven on (in the parking area). The existing drainfield is located where the addition is being proposed. METHODOLOGY The site was most recently investigated on June 9th, 2016 by making observations of the landscape (slope, drainage patterns, past use, etc.) as well as soil properties (depth, texture, structure, seasonal wetness, restrictive horizons, etc.) with hand auger borings (or probing) to a depth > 50 inches when possible. Additionally, the potential usable area is limited by cuts greater than 2 feet as well as gullies. Please note that these restrictive characteristics (soil and space) will prohibit the use of subsurface onsite systems (including aerobic drip irrigation). Therefore it has been determined that there is insufficient soil material and insufficient space to allow for any type of subsurface onsite septic system. An available option for this site may be to direct discharge into the surrounding Buck Creek (NPDES discharge permit). This option would need to be pursued through the NC Division of Water Resources. CONCLUSION The findings presented herein represent Mountain Soils Inc. professional opinion based on our site and soils evaluation and knowledge of the current laws and regulations governing on -site wastewater systems in North Carolina (Section .1900 of the North Carolina Administrative Code). In response to your inquiry about the low -flow characteristics (7Q10) for Buck Creek near Gneiss in southeastern Macon County, the following information is provided: A check of the low -flow files here at the USGS South Atlantic Water Science Center (Raleigh office) does not indicate a previous low -flow determination on Buck Creek at the point of interest, as identified by the lat/long coordinates you provided (35.124, -83.259) via email dated October 19, 2016. No USGS discharge records are likewise known to exist for the point of interest. In the absence of site -specific discharge records sufficient for a low -flow analysis, estimates of low -flow characteristics at ungaged locations are determined by assessing a range in the low -flow yields (expressed as flow per square mile drainage area, of cfsm) at nearby sites where such estimates have previously been determined. A basin delineation completed using the online USGS StreamStats application for North Carolina (http://water.usgs.gov/osw/streamstats/north carolina.html) indicates the drainage area for the point of interest is approximately 9.7 sqmi. For streams in Macon County, low -flow characteristics published by the USGS are provided in two reports: (1) The first is a statewide report completed in the early 1990's. It is USGS Water -Supply Paper 2403, "Low -flow characteristics of streams in North Carolina" (Giese and Mason, 1993). An online version of the report is available at http://pubs.usgs.gov/wsp/2403/report.pdf. The report provides the low -flow characteristics (based on data through 1988) via regional relations and at -site values for sites with drainage basins between 1 and 400 sqmi and not considered or known to be affected by regulation and/or diversions. Inspection of both reports indicates the presence of 8 nearby selected USGS partial -record sites (6) and continuous -record streamgages (6) in general vicinity of the point of interest where low -flow characteristics have previously been published. Applying the above annual 7Q10 yield range to the drainage area for the point of interest (9.7 sqmi) results in an estimated annual 7Q10 discharge from about 2.5 to 6.9 cfs (average approximately 4.8 cfs). This inspection was conducted to gather additional information about site suitability for a potential issuance of a General NPDES discharge permit through the North Carolina Division of Water Resources. Mark Brooks, Brooks Engineering, was contacted before the site visit Observations of the subject property, site history and receiving stream are as follows: There are currently two structures located on the property. Permit application indicates a request for a permitted flow of 240 gpd, however, property records list three bedrooms in the main structure. There are no records for the projected flow of the second structure. Discussions with the Macon County Environmental Health Department indicate drain lines were/are connected to the current septic tank from the secondary structure. Need clarification on number of bedrooms for permitted flow. Inspectors saw evidence of a current construction project. Footers and rebar were observed on the right side of the main structure. Inspectors learned from the Macon County Environmental Health Department this area is part of the original septic system. An NOV from the Macon County Environmental Health Department lists the owners as non-compliant because drain lines were severed during construction. According to Macon County Environmental Health Officials, the owners were previously denied an improvement permit in 2015 because the structure being built would be located over the current septic system. The property is unsuitable for repair. No repair area designated in 1974. Additionally, Inspectors observed construction debris and materials on the edge of the bank above Buck Creek. A suitable classification generally indicates soil and site conditions favorable for the operation of a ground absorption sewage treatment and disposal system or have slight limitations that are readily overcome by proper design and installation, b) Sites classified as PROVISIONALLY SUITABLE may be utilized for a ground absorption sewage treatment and disposal system consistent with these Rules but have moderate limitations. Sites classified Provisionally Suitable require some modifications and careful planning,design, and installation in order for a ground absorption sewage treatment and disposal system to function satisfactorily. c) Sites classified UNSUITABLE have severe limitations for the installation and use of a properly functioning ground absorption sewage treatment and disposal system. Such sites shall be reclassified as PROVISIONALLY SUITABLE if the local health department determines that the substantiating data indicate that: 1) a ground absorption system can be installed so that the effluent will he non- pathogenic, non-infectious, non-toxic, and non-hazardous; 2) the effluent will not contaminate groundwater or surface water; and 3) the effluent will not be exposed on the ground surface or be discharged to surface waters where it could come in contact with people, animals, or vectors. We submitted an application for Rita Woodside (Joe Rayle’s wife) for a single family discharge system back in December. They have a failing septic, no repair, and Macon County mandated they get the discharge permit. We have since then been trying to get a handle on where the application is in the review process. Mr. Weaver was kind enough to look for the application and he provided that status report that “it had not been issued to anyone”. We really are not sure what that means and still have no idea what the time frame might be for the application review. The owners have been in Florida for the winter but are planning on returning to their home in WNC but they have working wastewater disposal. Regarding the overall Number of Bedrooms: The main residence ONLY CONTAINS two sleeping rooms--- we are proposing removing an attic loft bedroom and replacing same with the new, enlarged master bedroom, (2 bedrooms existing, 2 bedrooms proposed) accessed through this loft space. The third bedroom depicted on the land records, is apparently within the cottage. We have been told that this structure IS NOT a sleeping room, but, nonetheless, that structure is not being affected by the proposed renovations, so IF THAT WERE considered a third bedroom, we would be looking at a 3 bedroom existing to a 3 bedroom proposed.
