The Wilmington Regional Office received a General Permit application on September 28, 2009,
to rebuild the wastewater treatment facility. Due to a misinterpretation of the rules, staff required
a permit for the wastewater treatment facility and for the two subsequent redevelopment
projects. After meeting with the Coast Guard on October 20, 2009, regarding the 3 separate
building projects at this site, the WWTF expansion, the Armory foundation, and the Public
Works Building Replacement, the Division agrees that the projects are not subject to State
Stormwater permitting at this time due to the following:
1. None of the proposed projects is located within the drainage area of the previously
approved BMP;
2. None of the projects require a CAMA Major or a Sedimentation Erosion Control Plan;
3. None of the projects exceed 10,000 square feet of new built -upon area.
Please keep in mind that this determination applies only to the current proposed activities.
Future disturbance or construction of impervious surfaces in excess of 10,000 square feet, or
such that either an Erosion and Sedimentation Control Plan or a CAMA Major permit is required,
will result in the requirement to submit a Stormwater Management Permit application prior to
construction.

I was disappointed to learn that the Fax sent to you on October e 2004 regarding the vegetated Swale was
lost. I have attached a copy of the Fax and the information submitted along with full-size plan sheets where
the details can be found of the items requested concerning the vegetated swale. Please note that the site
plan on Sheet C l indicates a 36 ft. wide spillway and note 6 on that sheet requires all disturbed areas to be
sodded. Section CI on Sheet 7 that indicates the spillway length is a minimum of 86 ft which exceeds the
required 50 feet and that it is sodded. These items should cover the additional information requested.
I will fax this letter and the previous information faxed on October 8"', 2004 and FedEx the noted
documents so that you will receive them on November 23, 2004. Any effort you make to expedite the
approval of this permit would be appreciated and would allow the USCG to begin the construction of the
project to begin treating the stormwater runoff from their site. Should you have any questions during your

Our firm submitted an application for the US Coast Guard Group — Fort Macon to construct a project to
begin the treatment of stormwater for the station that was received by the Division of Water Quality on
April 2, 2004. Please note that this facility was constructed prior to the initiation of stormwater treatment
regulations and that no runoff from this site is currently treated in any fashion. Our client would like to
begin construction of this system and requested we ascertain what the status of the stormwater permit is for
this project. Following is a timeline of the information submitted to DWQ pertaining to the project:
April 2, 2004 Permit application received by DWQ
June 28, 2004 DWQ requests additional information
July 5 - 19, 2004 Requested DWQ clarification on additional information requested
,lulu 20, 2004 Submitted additional information to DWQ
October 8, 2004 Received Fax from DWQ requesting information on vegetated spillway
October 8,2004 Submitted information via Fax on vegetated spillway (directed reviewer
to detail on plans indicating sod requirements for spillway).
It has been over 120 days since the submission of the additional data on July 20, 2004. Since our client is
extremely interested in aettina this stormwater project underway, please let us know if any additional
information is required that will help DWQ in their review of the permit package. Should you have any
