The Division of Energy, Mineral and Land Resources (DEMLR) has reviewed your submittal of the No
Exposure Certification for Exclusion from NPDES Stormwater Permitting form, which we received on
08/19/2020. The Division is unable to concur with your certification of no exposure,
Based on an inspection of your facility, Wilmington Regional Office staff found that industrial activities
or materials on your site either are exposed or have the potential to be exposed for the following reasons:
• Pallets and raw materials are stored in yard.
• Greater clarification of procedures for truck washing needed.
Please see the enclosed inspection report for more details. As such, the Division cannot grant your
requested exemption from permit coverage when industrial activities or materials are exposed or have the
potential to be exposed. PIease continue to operate under General Permit NCG080977.
