REQUEST FOR INFORMATION- STORMWA TER MANAGEMENT PLAN
Dear Ms. Stiefel,
On June 29, 2009, the 401 Oversight/Express Review Permitting Unit of the Division of Water Quality
(DWQ) issued a 401 Water Quality Certification to you and DavidLand LLC to place fill within or
otherwise impact 0.294 of wetland and 873 linear feet of unnamed stream to Steele Creek in order to
construct the proposed facility in Mecklenburg County.
Condition #7 of the 401 Certification requires you to get a final written approval of the stormwater
management plan (SMP) for the project from DWQ or a local delegated authority before the approved
impacts can occur. When the SMP is approved by a local government, you are required to submit the
following to the DWQ 401 Oversight office:
• A copy of the approved SMP, including construction plans details, signed and notarized operation
and maintenance (O & M) agreements(s), design calculations and other supporting information
along with a valid "Approval Letter" from the local government or the listed documents stamped
as "Approved" by the local government.
On August 23, 2010, the DWQ received SMP sheets stamped as approved by the City of Charlotte from
Brandon Plunkett, PE of John R. McAdams Company, Inc but without the design calculations and O & M
agreements. Please submit the design calculations and operation and maintenance agreement(s) that were
approved with the SMP plan sheets submitted to this office. Two copies of the requested information
must be received by this office within thirty (30) days from the date of this letter.
This letter only addresses the issues in question and does not authorize any impacts to wetlands, waters or
protected buffers. Please be aware that any impacts requested within your application are not authorized (at
this time) by the DWQ until all conditions in the Certification are met including the SMP requirement.
