Dear Mr. Chapin:
Please find attached the Pre-Construction Notification package for the proposed Foothills
Commerce Center - Phase One on Artee Road in Cleveland County for review. The Owner is
proposing to construct a business development center in multiple phases as interested businesses
step forward. The project site is divided by Little Beaverdam Creek; the east side is currently
being farmed and the west side has been forested. A creek crossing consisting of a 60-inch
HDPE pipe with endwalls and fill for a road and utilities is proposed in the first phase of this
project and is shown on Sheet C-113. A second creek crossing consisting of a 12-inch ductile
iron sanitary sewer line will be installed as shown on Sheet C-112.

The proposed site is located west of Shelby, just off of highway US 74 and can be accessed from
Artee Road (SR 1314) and Plato Lee Road (SR 1310. The properly location is indicated in the
attached parcel neap 6-100 Block 1 lot 16 and as outlined on the attached aerial photo of [lie area.
The attached prospective site development plan also shows the parcel with a potential layout of
the commerce center, including building footprints and roads. The property area is just over 152
acres. This preliminary site assessment is provided in accordance with North Carolina's current
Certified Industi-ial Site guidelines and represents a general waters and wetlands review of the
property without a detailed delineation. However, the available topographic map of the site
provides a good basis for mapping the approximate location of the drainage features on the site
that represent areas that would likely be jurisdictional under Federal Clean Water Act provisions.
Site Description
The current property site use is predominately row crop agriculture. Soy beans are the current
crop being grown on the site. The planted area is clearly indicated on the attached aerial photo.
This portion of the project has been under row crop management for some time. The topography
of the site is relatively flat with low rolling hills within the site. The small wooded (low growing
vines, shrubs and small to medium size trees) "fingers" extending into the soy bean field
represent small drainage features on the site that have relatively deep, eroded channels that carry
site drainage toward established streams. The area of the site along Artee Road slopes generally
fi-om north to south with a small "ridge line" that divides the agricultural portion of the site
roughly in half with the eastern portion draining generally eastward to an unnamed tributary of
Little Beaver Dam Creek and the western portion toward Little Beaver Dam Creek.
The portion of the property west of Little Beaver- Darn Creek that is bordered on the west by
Plato Lee Road is wooded with a series of old unmaintained roads and trails. The property
slopes from west to east, draining toward Little Beaver Darn Creek.
The one named stream on the site, referenced above as Little Beaver Dam Creek, runs north to
south and bisects the property along the western boundary of the "main" part of the site (property
to the east is agricultural use). The stream is marked on the attached maps. This is clearly a
" water° of the US" and any fill or modification of the strearn would require a Cleats Water Act
Section 404 Permit from the Corps of Engineers and a Section 401 Certification fi-om the North
Carolina Division of Water Quality. The proposed site plan shows a prospective crossing of a
site road that may require permitting. This type of "fill" is considered a nunor impact and can be

permitted tluougl? a General Permit and Ce2-tification process that is relatively simple. The final
project development plan may also use alternate access and eliminate the crossing or use
construction practices that bridge the stream from "high ground to high ground" avoiding any
permit requirements.
Sttc Rec onTiMss'ance
On September 23, 2009, the writer perfori-ned a site reconnaissance visit to the property to
confirm the infon-nation available for this site concerning wetlands and waters that may be on the
proper-t y.
The site is well elevated above the per;rranent streams on or near the site. The "tirngers" of
vegetated areas externding into the row crop are drainage features and are clearly not "yvaters of
the US_- Bused on cun-errt jurisdictional guidelines, these features sire not regulated under
Sections 401 and 404 of the Clean Water Act. Final site development plans WOUld include
conlurniation of this with the appropriate regulatory agencies, but there is no obvious evidence
that any of these f eatlnres are waters or contain wetlands.
Within the portion of the property west of Little Beaver- Dam Creek, the wooded area contains
only one weak drainage feature that is clearly only a drainage feature and doesn't contain
wetlands or -waters.
Little Beaver Dam Creek that generally divides the property between the wooded portion and the
agricultural portion is, as noted, a stream that would be regulated tinder the Clean Water Act.
The stream is deeply incised and the surface of the water flow is well below the bank area along
the creek. The stream corridor is thickly vegetated with invasive vine species and contains many
shrubs and. trees of various sizes and age. The adjacent topography shows no indication of
wetland areas or areas where wetlands typically form. Stream banks are steep and the channel
well below riparian land area. The site has been "cut over" in recent years for timber harvest. It
was noted that an adjacent parcel along Plato Lee Road has recently been logged. Due to the
extremely thick vegetation, the actual stream channel and associated bank would have to be field
located during site development and grading to protect the stream area and avoid encroacInuent
into jurisdictional areas. The Creek forns the western property boundary for the main portion of
the property and the preliminary site plan shows the maintenance of a planted buffer along the
property line and stream. No "fill" or "modification" of the stream is planned along this area and
the one crossing is currently planned within the section of Little Beaver Dam Creek that crosses
the site is discussed in the Site Description of this report. Permitting of this impact if necessary
should pose no significant regulatory concern.
It should also be noted that a sewer easement 40 feet wide runs along Beaver Dam Creek and its
presence would prohibit certain types of Construction or modification in this easement area as
weR
The north end of the eastern boundary of the property runs along Metrolina Drive along high
gr-otrnd and is adjacent to the soy bean field. The south end of the eastern bounndary runs along a
prominent drainage feature. This unnamed tributary to Little Beaver Darn Creek is a stream and
wcu.ld be jurisdictional ,vatcrs of the US and subject to the requirements of the 'lean Water Act.
The stream corridor is wooded and the stream meanders along this property line. 1v1o
development cf this area is planned and the preliminary site plan shows a planted buffer along
the creek. The stream charnel is very deep and incised with bigb banks and no adjacent low
areas ?vfiere wetlands typically fon-n. No wetland areas or areas wliere wetlands may forni were
present along this stream corridor. This stream is more accessible on the east bank of the

The site has limited jurisdictional waters as noted and development plans show only one area
wliere regulatory permitting allay be required. The site assessment did not detect ?s?etlands or
areas wbere wetlands typically form and there Nvas no obvious evidence that these features
existed on the site. Stream areas that are considered jurisdictional have been noted. This site can
certainly be planned, engineered and developed witli minimal impact to water quality in the
Tittle Beaver Dam Creek drainage. Pet-niitting of the very limited proposed impact is well within
notarial regulatory process.
