PROJECT SUMMARY: The applicant proposes to add a new section of floating dock and boatlift for a total of 3 slips. Kerry Svoboda Page 2 9. PROJECT DESCRIPTION: The project site is located at 2 Banks Road on Figure Eight Island, adjacent to Banks Channel and Middle Sound, in New Hanover County. The island is accessed from the mainland at the end of Edgewater Club Road (SR 1402), by private bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which traverses Middle Sound. Heading east on the causeway, turn right on Beach Road South and travel south approximately 0.9 miles. Turn right onto Banks Road and continue until you reach the property which will be located on the right. The property borders Banks Channel on the southern end of the island. There is an existing two story single- family residence on the lot that is approximately 0.5 acres in size and 4' above normal high water (NHW). Upland vegetation on the property currently consists of natural dune vegetation such as Indian Blanket (Gallardia pulchella), pennywort (Hydrocotyle bonariensis), saltmeadow hay (Spartina patens) and fig (ficus sp.) The approximately 107 linear feet of shoreline frontage is currently stabilized by a timber bulkhead that approximates normal high water (NHW), constructed sometime before 1999, no permit history was found for the bulkhead. A small area of bulkhead failure was noted on the southern end near the property line. The bulkhead approximates high water for the majority of the shoreline. A small wedge of sand beach approximately 10' at the widest point is located on the northside of the parcel waterward of the bulkhead. The applicant currently maintains an existing private docking facility authorized by General Permit # 20450-D, which was issued on 6/7/1999. The existing access pierextends into Banks Channel, measuring approximately 71' in length by 6' in width, terminating onto an uncovered fixed 1-head" platform that extends south, measuring approximately 16' in length by 12' in width. An access ramp continues south from the platform onto a floating dock, measuring approximately 16' in length by 8' in width, which runs parallel to the shoreline. Maintenance excavation within the existing slips was authorized by General Permit#45866 on 6/19/07 to depths ranging from -2 to -3.5 NLW. On 10/14/2009 a single pile davit lift was authorized by General Permit # 53991-D. This davit was not there at the time of the site visit. The most recent permit, General Permit # 72389-D, was issued on 1/10/2019 to replace the existing floating dock with a 24' by 8' floating dock. The existing docking facility currently accommodates up to two (2) vessels. The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacentwaters and high ground portion at the property as Conservation. The waters of Banks Channel and Middle Sound are classified SA-ORW by the Division of Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT: 9. The applicant proposes to add a new section of floating dock and boatlift for a total of 3 slips. A 16' by 6' floating dock would be added to the southern end of the existing floating dock, positioned perpendicular to the shoreline. The applicant proposes to install a new 14' by 14' boat lift on the southern side of the proposed new float. The proposed new floating dock and boatlift would extend an additional 6' into the waterbody so the new facility would extend a total of 88' into the water from the bulkhead and provide docking space for up to three (3) vessels. The application states that the existing water depth in the area of the proposed docking structures would be approximately -3.0' at normal low water (NLW) landward of the float and approximately -5' NLW waterward of the floating dock (See Drawing 1 of 2). Kerry Svoboda Page 3 10. ANTICIPATED IMPACTS: The proposed structures would incorporate approximately an additional 292 ft2 of Estuarine Waters and Pubic Trust Area. The proposed structure would extend approximately 88' into a waterbody, which measures approximately 406' across. This distance would conform to both the 1/4 rule and the established pier lengths. The proposed structures would not encroach into the adjacent 15' Riparian Corridor Setback Area requirement. Total slip count would increase from two (2) to three (3) boat slips. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. If this agency does not render a permit decision within 70 days from November 10, 2020, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of- way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application. An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State or Federal agency.
