Dear Mr. Gilbert:
On July 14, 2010, the Division of Water Quality(DWQ) received your application dated April 28, 2010,to fill
or otherwise impact 149 linear feet of perennial stream, and 8,282 square feet of Zone 1 Neuse River basin
protected riparian buffer,and 4,836 square feet of Zone 2 Neuse River basin protected riparian buffer,to
construct the proposed residential development at the site. The DWQ has determined that your application was
incomplete and/or provided inaccurate information as discussed below. Additional information was received
from you on August 12, 2010.
After reviewing this information, it has been determined that DWQ will require additional information in order
to process your application to impact protected wetlands and/or streams on the subject property. Therefore,
unless we receive five copies of the additional information requested below, we will place this project on hold
as incomplete until we receive this additional information. If we do not receive the requested information,your
project will be formally returned as incomplete. Please provide the following information so that we may
continue to review your project.
Additional Information Requested:
I. Your buffer restoration plans included permanent seeding specifications. These specifications listed tall
fescue, sericea lespedeza, kobe lespedeza, and Pensacola bahiagrass. All of these species are
considered invasive exotic species, and are not desirable in a riparian buffer restoration project where
native vegetation is required. In addition, it has been our experience that these species often
outcompete bare-root tree seedlings, or at a minimum, cause slow growth and diminished vigor.
Please re-submit your planting plan and omit the above-referenced permanent seeding plants. The N.C.
Ecosystem Enhancement Program Guidelines for Riparian Buffer Restoration
(http://portal.ncdenr.orWweb/wq/swp/ws/40 I/riparian buffers/links) includes a list of native grass
species suitable for riparian buffer restoration. Alternatively, a riparian seed mix can be obtained from
commercial nurseries specializing in native plants. A list of such nurseries is included in the
Guidelines.

Please submit this information within 30 calendar days of the date of this letter. If we do not receive this
requested information within 30 calendar days of the date of this letter,your project will be withdrawn and you
will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or
protected buffers. Please be aware that any impacts requested within your application are not authorized(at this
