Dear Mr. Fox:
The Final Engineer Certification for the subject project was received by our office on August 10,
2020 and reflects non-compliance with the subject permit, 15A NCAC 02T regulations, and the
Division's Minimum Design Criteria. The violations are described below and require your
attention and action:
1) 6-inch gravity sewer was installed between MH-1 and MH-2 (Shown of Sheet C-1 of the as -
built drawings) as opposed to the 8-inch gravity sewer authorized by the permit. This finding
also represents non-compliance with 15A NCAC .0305 (i) (1), which requires public sewers
be equipped with a minimum of 8-inch diameter pipe, and 15A NCAC 02T .0116 (a) which
states: Prior to the operation of any sewer system, treatment works, utilization system, or
disposal system for which an individual permit has been issued in accordance with this
Subchapter and the application prepared by licensed professional, a certification shall be
received by the Division from a professional certifying that the sewer system, treatment works,
utilization system, or disposal system has been installed in accordance with the rules, all
minimum design criteria except as noted, and approved plans and specifications.
Please be aware, in accordance with the subject permit, it shall be the responsibility of the
Permittee to ensure that the as -constructed project meets the appropriate design criteria and rules.
Failure to comply may result in penalties in accordance with North Carolina General Statute § 143-
215.6A through § 143-215.6C, construction of additional or replacement wastewater collection

facilities, and/or referral of the North Carolina -licensed Professional Engineer to the licensing
board.
Please submit a written response that provides a description of the proposed corrective action(s)
to be implemented to address the violation(s) described herein. Your written response should
include an anticipated schedule for the implementation of the corrective action(s) proposed and
shall be received within 10 days of receipt of this Notice. The corrective action(s) proposed to
reconcile the described violation(s) shall be installed and certified within 120-days of receiving
Division approval of the proposed corrective measures.
In accordance with North Carolina General Statute 143-215.1, flow shall remain non -tributary
to the subject sewer extension, until a certification is received by the Division from a professional
certifying that the sewer system authorized by the subject permit has been installed in accordance
with the rules, all minimum design criteria except as noted, and approved plans and specifications.
