Dear Mr. Overton: •
The subject Certificate of Coverage (CoC) expired on September 30, 2006. Your company failed to
request renewal of the CoC, as required in section I. B. 8 of General Permit NCG510000 and
existing state and Federal regulations.
A Notice of Violation was sent to you via certified mail on June 5, 2006. Records from the U.S.
Postal Service confirm that the NOV was delivered on June 8, 2006. To date, the Division has
received no response.
Therefore, in accordance with sections I. B. 8, I. B. 14 & I. B. 15 of NCG510000, NCG510335 is
terminated, effective immediately. If in the future your company wishes to discharge
wastewater from this location, you must first apply for and receive a renewed CoC. Discharge of
wastewater without a valid NPDES permit will subject the responsible party to a civil penalty of
up to $25,000 per day.

Enclosed are three copies of an application for a general NPDES permit and an
Authorization to Construct for the construction and operation of a groundwater
treatment system at the above-referenced site. The application includes sizing criteria,
plans, and specifications for a groundwater recovery and treatment system which will
treat water containing dissolved petroleum hydrocarbons as a result of leaking
underground storage tanks. An application fee of$550 is also enclosed.

Dear Mr. Overton:
The Permits and Engineering Unit is returning your application received September 2, 1994. We
are terminating the NPDES application process for the Gilliland's Place groundwater remediation in
Gaston County. On September 23, 1994 an additional information letter was sent requesting further
information to complete the application. As of December 5, 1994, the additional information was not
received in our office. Therefore the Division is returning the original application package at this time.
Please be advised that should you wish to seek an NPDES permit for this facility in the future, you
will have to resubmit an application package and the appropriate application fees. If you have any
questions, feel free to contact Charles Alvarez at 919-733-5083.
If you determine that you wish to operate a wastewater discharge system, you must first apply for
and receive a NPDES Permit. Please be advised that there is $10,000 violation per day for unpermitted
discharges to surface waters as subject to standards found in 15A NCAC 2B .0200.
