NCG510000 expires on September 30, 2006. Federal (40 CFR 122.41) and North Carolina (15A NCAC 2H.0105(e))regulations require that permit renewal applications must be filed at least 180 days prior to expiration of the current permit. If you have already mailed your renewal request, you may disregard this notice. To satisfy this requirement, the Division must receive your renewal request postmarked no later than April 3, 2006. Failure to request renewal by this date may result in a civil assessment of at least $500.00. Larger penalties may be assessed depending upon the delinquency of the request. If any discharge from the remediation system will occur after September 30, 2006,your CoC must be renewed. Discharge of wastewater without a valid permit would violate North Carolina General Statute 143- 215.1; unpermitted discharges of wastewater may be assessed civil penalties of up to $25,000 per day. The nearest sanitary sewer system is located approximately one mile from the site. Discharge to an infiltration gallery: The use of an infiltration gallery was evaluated and found not to be a viable alternative given the presence of bedrock at a shallow depth. 5 . Air Quality and/or Groundwater concerns or hazardous waste utilized at this facility that may impact water quality, air quality or groundwater? Contaminated groundwater already exists at the site. No hazardous waste will be generated. Air Quality Permit for this facility is not required. However, registration with the Air Quality Section is required. NPDES Permit Staff Report Version 10/92 Page 3 //lir PART IV - EVALUATION AND RECOMMENDATIONS Pacemaker Leasing Company is requesting an NPDES Permit for the discharge of treated groundwater resulting from a leaking underground storage tank. The proposed method of treatment is typical of treatment methods used by the petroleum industry for groundwater remediation activities. Field investigation revealed that the treatment system is being constructed approximately 15 feet from a residence. The treated water will then be piped across Hickory Grove Road to the receiving stream, an intermittent stream that flows through an undeveloped area prior to entering the South Fork of the Catawba River. Due to the proximity of a dwelling, this Office is recommending that Pacemaker Leasing Company obtain written approval from the dwelling owner prior to constructing any facilities, since nuisance conditions (ie - noise) may occur. The effluent from similar facilities has been known to fail toxicity testing. It is recommended that the NPDES Permit be issued once the above mentioned concerns regarding nuisance and toxicity have been addressed.
