Crowders Creek WWTP-Additional Bar Screen

Dear Mr. Bost:
A letter of request for an Authorization to Construct was received January 25, 2010, by the
Division of Water Quality (Division), and final plans and specifications for the subject project have been
reviewed and found to be satisfactory. Authorization is hereby granted for the construction of
modifications to the existing 6.0 MGD Wastewater Treatment Plant, with discharge of treated
wastewater into Crowders Creek in the Catawba River Basin.
This authorization results in no increase in design or permitted capacity and is awarded
for the construction of the following specific modifications:
Installation of an additional mechanical bar screen (rated for 12 MGD peak flow) at the
Crowders Creek WWTP headworks structure, in conformity with the project plans,
specifications, and other supporting data subsequently filed and approved by the
Department of Environment and Natural Resources.
This Authorization to Construct is issued in accordance with Part III, Paragraph A of
NPDES Permit No. NC0074268 issued April 1, 2006, and shall be subject to revocation unless
the wastewater treatment facilities are constructed in accordance with the conditions and
limitations specified in Permit No. NC0074268.
The sludge generated from these treatment facilities must be disposed of in accordance
with G.S. 143-215.1 and in a manner approved by the Division.
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as may

be required by the Division, such as the construction of additional or replacement wastewater
treatment or disposal facilities.
The Mooresville Regional Office, telephone number(704) 663-1699, shall be notified at
least forty-eight (48) hours in advance of operation of the installed facilities so that an on site
inspection can be made. Such notification to the regional supervisor shall be made during the
normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State
Holidays.
Upon completion of construction and prior to operation of this permitted facility, a
certification must be received from a professional engineer certifying that the permitted facility
has been installed in accordance with the NPDES Permit, this Authorization to Construct and the
approved plans and specifications. Mail the Certification to: Construction Grants & Loans,
DWQ/DENR, 1633 Mail Service Center, Raleigh, NC 27699-1633.
Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the
wastewater treatment facilities. The operator must hold a certificate of the type and grade at
least equivalent to or greater than the classification assigned to the wastewater treatment
facilities by the Certification Commission.
The Permittee must also employ a certified back-up operator of the appropriate type and
grade to comply with the conditions of T15A:8G.0202. The ORC of the facility must visit each
Class I facility at least weekly and each Class II, III and IV facility at least daily, excluding
weekends and holidays, must properly manage the facility, must document daily operation and
maintenance of the facility, and must comply with all other conditions of T15A:8G.0202.
A copy of the approved plans and specifications shall be maintained on file by the
Permittee for the life of the facility.
During the construction of the proposed additions/modifications, the permittee shall
continue to properly maintain and operate the existing wastewater treatment facilities at all times,
and in such a manner, as necessary to comply with the effluent limits specified in the NPDES
Permit.
You are reminded that it is mandatory for the project to be constructed in accordance
with the North Carolina Sedimentation Pollution Control Act, and when applicable, the North
Carolina Dam Safety Act. In addition, the specifications must clearly state what the contractor's
responsibilities shall be in complying with these Acts.
Prior to entering into any contract(s) for construction, the recipient must have obtained all
applicable permits from the State.

Failure to abide by the requirements contained in this Authorization to Construct may
subject the Permittee to an enforcement action by the Division in accordance with North
Carolina General Statute 143-215.6A to 143-215.6C.
The issuance of this Authorization to Construct does not preclude the Permittee from
complying with any and all statutes, rules,regulations, or ordinances which may be imposed by
other government agencies (local, state, and federal) which have jurisdiction.

been reviewed and found to be satisfactory. Authorization is hereby granted for the construction of
modifications to the existing 6.0 MGD Wastewater Treatment Plant, with discharge of treated
wastewater into Crowders Creek in the Catawba River Basin.

Dear Mr. Cummings:
A letter of request for Authorization to Construct was received April 29, 2005, by the
Division, and final plans and specifications for the subject project have been reviewed and found
to be satisfactory. Authorization is hereby granted for the construction of modifications to the
existing 6.0 MGD Crowders Creek Wastewater Treatment Plant, with discharge of treated
wastewater into the Crowders Creek in the Catawba River Basin.
This authorization results in no increase in design or permitted capacity and is awarded
for the construction of the following specific modifications:
Rehabilitation of one exisiting digester with new fixed cover, installation of a sludge
mixer, associated piping and appurtenances; and piping modifications to the second
digester, in conformity with the project plan, specifications, and other supporting data
subsequently filed and approved by the Department of Environment and Natural
Resources.
This Authorization to Construct is issued in accordance with Part III, Paragraph A of
NPDES Permit No. NC0074268 issued September 9, 2003, and shall be subject to revocation
unless the wastewater treatment facilities are constructed in accordance with the conditions and
limitations specified in Permit No. NC0074268.
The sludge generated from these treatment facilities must be disposed of in accordance
with G.S. 143-215.1 and in a manner approved by the North Carolina Division of Water Quality.
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as may
be required by this Division, such as the construction of additional or replacement wastewater
treatment or disposal facilities.

The Mooresville Regional Office, telephone number(704) 663-1699, shall be notified at
least forty-eight(48) hours in advance of operation of the installed facilities so that an on site
inspection can be made. Such notification to the regional supervisor shall be made during the
normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State
Holidays.
Upon completion of construction and prior to operation of this permitted facility, a
certification must be received from a professional engineer certifying that the permitted facility
has been installed in accordance with the NPDES Permit, this Authorization to Construct and the
approved plans and specifications. Mail the Certification to Cecil G. Madden, Jr., P.E.,
Construction Grants & Loans, DWQ / DENR, 1633 Mail Service Center, Raleigh, NC 27699-
1633.
Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the
wastewater treatment facilities. The operator must hold a certificate of the type and grade at
least equivalent to or greater than the classification assigned to the wastewater treatment
facilities by the Certification Commission.
The Permittee must also employ a certified back-up operator of the appropriate type and
grade to comply with the conditions of T15A:8G.0202. The ORC of the facility must visit each
Class I facility at least weekly and each Class II, III and IV facility at least daily, excluding
weekends and holidays, must properly manage the facility, must document daily operation and
maintenance of the facility, and must comply with all other conditions of T 15A:8G.0202.
A copy of the approved plans and specifications shall be maintained on file by the
Permittee for the life of the facility.
During the construction of the proposed additions/modifications, the permittee shall
continue to properly maintain and operate the existing wastewater treatment facilities at all times,
and in such a manner, as necessary to comply with the effluent limits specified in the NPDES
Permit.
You are reminded that it is mandatory for the project to be constructed in accordance
with the North Carolina Sedimentation Pollution Control Act, and, when applicable, the North
Carolina Dam Safety Act. In addition, the specifications must clearly state what the contractor's
responsibilities shall be in complying with these Acts.
Failure to abide by the requirements contained in this Authorization to Construct may
subject the Permittee to an enforcement action by the Division of Water Quality in accordance
with North Carolina General Statute 143-215.6A to 143-215.6C.
The issuance of this Authorization to Construct does not preclude the Permittee from
complying with any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state, and federal) which have jurisdiction.

Pursuant to provisions of North Carolina General Statutes (G.S.) 143-215.2, this Special Order by
Consent is entered into by the City of Gastonia,hereinafter referred to as the City, and the North Carolina
Environmental Management Commission, an agency of the State of North Carolina created by G.S.
143B-282, and hereinafter referred to as the Commission:
1. The City and the Commission hereby stipulate the following:
(a) That the City holds North Carolina NPDES Permit No.NC0074268 for operation of an
existing wastewater treatment works and for making an outlet therefrom for treated wastewater to
Crowders Creek, Class C waters of this State in the Catawba River Basin,but is unable to
comply with the final effluent limitations for total nitrogen set forth in the Permit. Compliance
will not require preparation of plans and specifications for and construction and operation of
additional treatment works.
(b) That noncompliance with final effluent limitations constitutes causing and contributing to
pollution of the waters of this State named above,and the City is within the jurisdiction of the
Commission as set forth in G.S. Chapter 143,Article 21.
(c) Since this Special Order is by Consent,neither party will file a petition for a contested case
or for judicial review concerning its terms.
•
2. The City, desiring to comply with the permit identified in paragraph 1(a) above,hereby agrees to do
the following:
(a) Comply with all terms and conditions of the permit except those effluent limitations
identified in paragraph 1(a)above. See Attachment A for all monitoring requirements and
effluent limitations. The permittee may also be required to monitor for other parameters as
deemed necessary by the Director in future permits or administrative letters.
(b) Undertake the following activities in accordance with the indicated time schedule:
1) Develop and implement technically based Industrial User Permit limitations for the
significant industrial users of concern for organic nitrogen by no later than September 1,
2002. MET
2) Progress reports shall be submitted by no later than September 15,2002, January 15,
2003,and March 15,2003 that detail actions the City has taken through the Pretreatment
Program to ensure a reduction of organic nitrogen to the facility and any process changes
within the WWTP to enhance treatment.
3) Achieve compliance with the NPDES Permit limitation by April 1, 2003.
(c) During the time in which this Special Order by Consent is effective,comply with the interim
effluent limitations contained in Attachment A. The following reflects only the limitations that
have been modified from NPDES requirements by this Order:

(d) No later than 14 calendar days after any date identified for accomplishment of any activity •

the reason(s) for noncompliance,remedial action(s)taken,and a statement identifying the extent
to which subsequent dates or times for accomplishment of listed activities may be affected.
3. The City agrees that unless excused under paragraph 4,the City will pay the Director of the
DWQ,by check payable to the North Carolina Department of Environment and Natural Resources,
stipulated penalties according to the following schedule for failure to meet the deadlines set out in
paragraphs 2(b)and 2(d), or failure to attain compliance with the effluent limitations/monitoring
requirements contained in Attachment A.
Failure to meet a schedule date $100/day for the first 7days; $500/day

4. The City and the Commission agree that the stipulated penalties are not due if the City satisfies
the DWQ that noncompliance was caused solely by:
a. An act of God;
b. An act of war;
c.An intentional act or omission of a third party but this defense shall not be available if the act
or omission is that of an employee or agent of the defendant or if the act or omission occurs in
connection with a contractual relationship with the permittee;
d. An extraordinary event beyond the permittee's control. Contractor delays or failure to obtain
funding will not be considered as events beyond the permittee's control; or
e. Any combination of the above causes.
•
Failure within 30 days of receipt of written DWQ and to pay the penalties, or challenge them by a
contested case petition pursuant to G.S. 150B-23,will be grounds for a collection action , which the
Attorney General is hereby authorized to initiate. The only issue in such an action will be whether the 30
days has elapsed.
5. This Special Order by Consent and any terms, conditions and interim effluent limitations contained
herein, hereby supersede any and all previous Special Orders and Enforcement Compliance Schedule
Letters, and terms, conditions, and limitations contained therein issued in connection with NPDES Permit
No. NC0074268.
6. Noncompliance with the terms of this Special Order by Consent is subject to enforcement action in
addition to the above-stipulated penalties, including injunctive relief pursuant to G.S. 143-215.6.
7. The permittee,upon signature of the Special Order by Consent,will be expected to comply with all
schedule dates,terms, and conditions of this document.
8. This Special Order by Consent shall expire July 1,2003.
