Since the proposed sewer crossing has been revised to allow for a 10' permanent
maintenance corridor, the proposed impacts are listed as "Exempt" in the Neuse River
Buffer Rules Table of Uses. Per Water Quality Certification No. 3821, Exempt
activities do not require written approval from the Division of Water Quality.
Therefore, the proposed project does not require written authorization from NC DWQ
and does not require an application fee.
3. Please supply confirmation from the US Army Corps of Engineers allowing you to
permit under a NW12 and not a NW29.
In an email dated July 23, 2010, Jamie Shern with the Corps of Engineers stated that a NWP
29 was applicable to the proposed project. A copy of the Corps of Engineers' email has been
provided as Appendix 2.
Page 1 of the PCN has been revised to identify that a NWP 29 is being requested and that the
use of NWP 29 has been verified by the Corps of Engineers. The revised Page 1 of the PCN
has been provided as Appendix 3.
Additional Information
Water Quality Certification No. 3821 for a NWP 29 requires that a courtesy copy of the PCN be
submitted to NC DWQ, along with a copy of the Stormwater Management Plan and approval
letter. Please note that it is the Town of Cary's policy to not issue final approval of the
Stormwater Management Plan until the applicable 401 and 404 authorizations have been issued.
In an email dated July 23, 2010, Matt Flynn, Stormwater Field Services Administrator for the
Town of Cary, verified that the Stormwater Management Plan was preliminarily approved.
Therefore, the Stormwater Management Plan meets all applicable stormwater requirements. A
copy of the email from the Town of Cary has been provided as Appendix 4. A copy of the
information submitted to the Town of Cary for approval of the Stormwater Management Plan has
been provided as Appendix 5.
