We are writing to express our opposition to Nassau Corporation's permit to discharge fill
material into a section 404 Wetland. Re: Army Corps of Engineers Action ID No.200200769
(Lot 113 Dolphin Ridge, Emerald Isle.) Our reasons for this opposition are many and include
most of the reasonably foreseeable detriments outlined in the Army Corp letter dated July
19,2002. The most important of these are flood hazards, flood plane values, wetland
preservation, fish and wildlife values and safety. We have included a number of photo
references that illustrate how much water is normally in this and adjoining wetlands in non-
drought years. (See Sept. 2000 photos.) The photos from March 2002 and July 2002
illustrate how quickly the water level changes with just a moderate amount of rain following
drought conditions.
As you are aware, a small portion of this lot was filled before construction was halted
because development was being done based on outdated wetland delineation maps. This fill
material has already begun to wash into the old wetland area despite the presence of a silt
fence because of recent rain events. It is also our belief that even if lot 113 is bulk headed
the topography and natural water flow will cause this area to continue to degrade. If this filling
is permitted to move forward more fill will wash into the remaining wetland area and further
affect water quality in this area. Also note that no mitigation is planned anywhere.
Our bottom line is the negative impact on the property and environmental values for us as
well as the adjoining lot holders in Dolphin Ridge and Spinnaker's Reach.
We have included letters from others concerned about this and I believe you have received a
more detailed letter from the board of directors of the homeowners association for Dolphin
Ridge. If a public hearing needs to be held we would be glad to participate along with others
in the impact area. If you require additional information please feel free to contact us at any

September 2000 'this picture shows the wetland area on the cast side of Outrigger Ct which is connected to 113 by a culvert under
the road. The road was raised in the late 1990's and the culvert added because of continued flooding of the street. It appears that the
developer's plan for lot 113 would block this culvert disconnecting the two wetland areas.
