Dear Mr. Baker and Mr. Parker.
The purpose.of this letter is to revise: the request for written authorization for wetland
impacts; under Nationwide .Permit 39 and its Water Quality Certification for the project
known as The Cliffs at Walnut Cove, Buncombe County, North Carolina. There will be
no wetland impacts at Site #8 (0.103 acres) or Site #9 (0.136 acres) within the
application dated October 14, 2002. Sites #8 and #9 have been replaced with new sites
#8 and #9 on the attached site map. We are requesting to impact the wetland at Hole
#9 that is currently dry. This was historically a watering hole for horses up until about a
month ago. A flowing stream with riffles, pools, and waterfalls will be created in this
area (Site #8). The source of hydrology will be from the irrigation system.
Due to the size of the drainage area, the poor quality wetland below the driving range
will need to be flooded for a water quality pond (New Site'#9). Originally this wetland
was going to be temporarily flooded during storm events. The drainage area requires
that a larger pond be built and that the pond have a permanent pool.
Mr. Baker and Mr.. Parker conducted an. additional site visit on December 6, 2002. Two
of the temporary. construction crossings, have. been installed. We had originally applied
for a Nationwide Permit 33 for the.. seven temporary, crossings, in September 2002. We
cannot find any legal .reason why this permit should not have been approved, but .Mr.
Baker requested that the impacts be included in the Nationwide Permit 39 so they were

included there also. The temporary crossings are better than the alternative which
would have needed no permit of just driving through the creeks. Mr. Michael
Brookshire of Buncombe County has suggested that temporary pipes are desired over
any other temporary crossing, including no structure for the crossing.
Mr. Baker and Mr. Parker have discussed and approved the aforementioned changes and
indicate that permit approval timelines will not be affected by this action. If you have
