As a follow up the site visit, this document should lay out the items of agreement and explain the Division of Water Qualities (and the U.S. Army Corps of Engineers) needs in order to process the submitted application. • As the White Oak River has a stable pattern and profile through the property in question, the Division of Water Quality sees no need for cross vanes to be constructed. • As pervious areas surround the sawmill operation, the Division of Water Quality does not need any constructed storm-water management in relation to this project. Any collected storm-water must be discharged, via diffuse flow, through the 25 foot vegetated trout buffer. • The submitted application package should be modified and resubmitted within 20 business days to remove any references to cross vanes, storm-water control berms, and storm-water control basins. • This office believes that re-vegetating the 25 foot trout buffer in accordance with the mitigation requirements stated in http://h2o.enr.state.nc.us/wrp//pdf/buffers.pdf will meet the needs of both agencies and provide necessary trout habitat along this segment of stream. While this list is inclusive of the needs of the Division of Water Quality in regards to bringing the un-permitted culverting activity into compliance with the state's water quality regulations, additional local government requirements may apply to this site.
