This letter is in response to a request from Mr. Matthew O'Brien (S&ME, Inc.) for the
Division's determination of the applicability of the Randleman Lake Water Supply Watershed
Protection Regulations, 15A NCAC 2B .0250 -.025 1, to the subject property. A site visit was
conducted on October 17, 2002. In attendance were Jennifer Frye (of this Office), Mr. O'Brien
and Joanna Kirkland (both of S&ME, Inc.). CPT Engineering and Surveying, Inc. has supplied
this Office with five copies of the Stream Delineation Map.
Based on this site visit, this Office has determined that the stream feature identified on
the enclosed map is SUBJECT to the Randleman Lake Water Supply Watershed Regulations,
including both the Protection and Maintenance of Riparian Areas and Stormwater Requirements.
The pond feature, also identified on the Map, is NOT SUBJECT to the above-cited Rules.
This letter addresses only the applicability of the Randleman Lake Water Supply
Watershed Regulations. Please keep in mind that there may be additional Federal, State,
and Local requirements for proposed activities at the subject property, specifically Sections
404 and 401 of the Clean Water Act. If you have any questions regarding this matter, please
