Director Division of Water Quality o Y September 16, 2002 CERTIFIED MAIL: 7002 0860 0007 8093 0079 Return Receipt Requested Mr. Grover Shugart Shugart Enterprises, LLC 3015 Maplewood Avenue Suite 201 Winston-Salem, NC 27103 tSEP SUBJECT: REQUEST FOR ADDITIONAL INFORMATION Castle Pines DWQ Project # 02 1274 Guilford County Dear Mr. Shugart: The Division of Water Quality has reviewed your plans for the discharge of fill material into 0.30 acres of wetlands and 149 linear feet of an Unnamed Tributary to Deep River, Cape Fear River Basin, Class WS-IV waters, Guilford County for the purpose of constructing the Castle Pines residential development. Insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional information. (1) Please provide us with information supporting your position that states your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Documentation such as maps, narratives, economic analyses, that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification request. (2) Please provide documentation detailing your position that the project has been designed such that adverse impacts to surface waters have been minimized and existing uses have been protected to the best of your ability. Division of Water Quality/Water Quality Section 585 Waughtown Street Winston-Salem, NC 27107 (336) 771-4608 Customer Service 1 800 623-7748 02 1274 Page 2 (3) You application included a Wetlands Key Map and culvert plan detail; however, these drawings do not have a directional indicator (North arrow) nor relative location landmarks (i.e. adjoining streets). The copy of the U.S.G.S. topographical map identifies the general site location, but it does not depict the actual property boundaries. Please submit a detailed site plan and U.S.G.S. map that accurately portrays the location and direction of the proposed development. (4) Please describe impervious acreage (both existing and proposed) versus total acreage on the site. (5) Your project is located within the Randleman Lake Water Supply Watershed Protection Area. Please be certain that your detailed plans show the entire proposed development with respect to all protected riparian areas, Zone 1 and Zone 2, streams and wetlands. Show the extent of all fill slopes and any proposed re-vegetation plans for any disturbance of Zone 2. (6) Even though road crossings are an allowable activity within the Randleman Lake Water Supply Watershed, you must demonstrate, as stated in 15A NCAC 02B .0250 (2)(e), that the project shall be (or will be) located, designed, constructed and maintained to have minimal disturbance, provide maximum nutrient removal and erosion protection, have the least adverse effects on aquatic life and habitat, and protect water quality to the maximum extent practical through the use of best management practices. Please address these issues in your response. (7) Please provide documentation that your proposed development is compliant with the City of High Point's Development Ordinance as it pertains to the Randleman Watershed Protection Rules. Include assurance that the culvert design and energy dissipater meet the approval of the City of High Point's Sediment and Erosion Control Program. (8) Even if written approval of a stormwater management plan may not be required as a condition of 401 WQ Certification, your project must still protect surface waters and wetlands downstream of the property. Please provide documentation regarding the management of the stormwater from this project. Please keep in mind that, per the Randleman Lake Water Supply Watershed Protection Rules, diffuse flow must be provided through the buffer zones to the maximum extent practical and temporary sediment and erosion control measures cannot be located within Zone 1. 02 1274 Page 2 Please respond, in writing, both to this Office and to John Dorney, 2321 Crabtree Blvd., Parkview Building, Raleigh, NC 27604-2260 within three weeks of receipt of this letter outlining your intent to proceed with this project or withdraw your application. If you wish to proceed, please address the items listed above.
