Dear Mr. and Mrs. Smith:
The Division of Water Quality (DW%is considering denial of your project for dredging a canal, boat basin and
boat ramp in wetlands. This Office has read the revised Avoidance and Minimization Follow up Report dated March
2002. The reason this Office is considering denial is -as follows:
1). The letter from the Division of Marine Fisheries voicing their concerns and requesting denial of this project;
2). Essential Fish Habitat (EFH) concerns;
3). The differences in the amount of impacts to coastal wetlands between the consultant (496 sf) and DCM
(1,488 sf);
4). The potential of cumulative impacts (this project will be setting a precedence for impacts for all the mosquito
ditches in that area. (CAMA already has at least four (4) projects waiting to see if this project is approved).
This Office strongly suggests a meeting with all the resource agencies on site at one time to attempt a joint
resolution for this project. Your consultant can set this up by contacting the resource agencies to set up a date and time.
Please respond within three weeks of the date of this letter by sending a copy of the information to myself and to
Cyndi Karoly, 401 Wetlands Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-2260, her phone number is [phone].
If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will
consider the project as withdrawn. If you have any questions, please feel free to call Joanne Steenhuis of my staff at (910)
