C. Edwards (Project No. 2232-353). The order approved 24 floating Boatslips. The current request is approval to reduce the existing number of community Boatslips to 14 and include a boatramp. The enclosed engineered drawing indicates the new configuration. Also, the request includes stabilization of approximately 500 feet of shoreline with Mountain Rock. A copy of the shoreline stabilization application is enclosed. The leased area will remain the same at 0.79 acres. The marina will provide access to Lake Norman for the residents of Hidden Harbour Subdivision. Application is being made to Duke Energy Carolinas, LLC for the required Federal Energy Regulatory Commission (FERC) permit to re-do the existing Boatslips, add a boatramp and stabilize the shoreline for this residential marina. We ask that you advise us, by return mail, of any comments you may have concerning this marina or any permits your authority may require. At the time the Plan was prepared for the Catawba-Wateree Project, the parcel abutting the identified portion of shoreline was being used by the licensee as a-lake maintenance facility. The work that was conducted at this facility is now contracted to an outside entity and the parcel is no longer used by the licensee. The licensee has received an offer Eor this parcel to be developed for residential purposes. As such, the licensee requests the above referenced reclassification and authorization for the marina lease. If the identified shoreline area and, abutting parcel are reclassified to "future commercial/residential" the proposed marina would be consistent with the approved Plan. As n} part of the consultation, the North Carolina State Historic Preservation Officer (SHPO) also reviewed the proposal. ey Cfl letter dated August 19, 1997, the SHPO indicated it is aware of no properties of architeotural, historic, or archaeological ~ significance which would be affected by the proposed work. '- The Commission oonsidered the effects of residential and O other types of development, including marinas, on the Lake Norman shoreline, in the environmental assessment (EA} prepared for the Q Plan. Z/ EA findings indicate that, by adhering to the EA ~~ recommendations for resource protection and existing Federal, state, and local regulations and permitting requirements, environmental resources at the project would bs protected. The Commission order approving the plan therefore requires the licenses to adhere to the conditions recommended in the EA, .L By letter dated July 28, 1997, W.C. Edwards agrees to comply with all Federal, state, and local agency recommendations, requirements, and conditions pertaining to the proposed marina. Commission staff reminds the liosnsee that it, as lesser and project liaensae,.is ultimately responsible for ensuring the construction, operation, and maintenance of structures or facilities on the aanveyed lands occurs in a manner that protests the scenic, recreational, and environmental values of the project, The licensee is further responsible for ensuring the recommendations in the order approving the Plan are adhered to. After review of the filed information, Commission staff considers the reclassification proposal to be reasonable. Since the identified shoreline area is no longer used for operational purposes by the licenses, Commission staff does Hat see a Head for the lioensee to retain the "project operations" classification in the Plan. Ths proposed reclassification or lease will not conflict with the operation of the project. y/ Lake Norman is one of 11 reservoirs within the Catawba- Wateres Project. The proposed lease and reclassification will occur on Lake Norman. Development impacts on the remaining project reservoirs wars also evaluated in the EA completed Por the Plan. ~,/ The EA was issued with Commission approval of the Plan on February 2, 1996.
