Dear Mr. Majewski:
On September 11, 2002, and on November 6, 2002, the Division of Water Quality received your
application and respective additional/revised information for a 401 Water Quality Certification for a project
located along Optimist Farm Road in Wake County. Subsequent to this review and an October 21, 2002,
meeting between Mr. Majewski, Scott Mitchell and Tom Norris of Spaulding and Norris, PA., and Raleigh
Regional Office and Central Office Staff of the Division of Water Quality, it has been determined that
additional information is necessary. Please re-submit your project with the following additions:
1) Impact area # 8:
-The plans depict a sewer line impact in Zone II of the Neuse Riparian Buffer.
Please indicate why the sewer line impacts cannot be avoided (moved outside of
zone 11).
-Please depict the building and driveway footprint for lot number 11. It is
unclear whether a house and driveway can fit on the subject lot and not impact
the buffer.
2) Impact area # 9:
-The plans depict a sewer line impact in the Neuse Riparian Buffer. Please
indicatewhy this impact cannot be avoided (moved outside of the buffer).
-Mitigation for sewer line impacts associated with non-perpendicular crossing
(zone I and zone II) will be required (please see below mentioned buffer
mitigation item).

3) Crossing area #3:
-With respect to the initial 20-foot wide road crossing and the impacts to the
buffer by an access road being located within the buffer zone, please provide a
plan that depicts the extent, scope, and methods of stream and buffer restoration.
(This should include plant species, an implementation and monitoring plan, and
a schedule)
4) Please provide plans that clearly depict how stormwater will be addressed. The Neuse
Riparian buffer Rules require diffuse flow prior to stormwater entering into the buffer.
5) If a no practical alternative decision cannot be reached by DWQ, subsequent to a review
of your response item number 2 (above), the Riparian Zone impacts to area number 9 that
have occurred due to the sewer line crossing, (depicted on the Covington Meadows
Subdivision Wetland and NRB Impact Analysis plan dated August, 26, 2002) will require
mitigatinn Sz ecifirally, the ijm arts of only he non--perpendicular ppAstion of the sewer
line crossing (that includes zone I and zone H impacts) will be required to be mitigated.
(Note: You may wish to make a navment into the Rin rian Riff .r
Restoration Fund administered by the NC Wetlands Restoration Program
(WRP) to meet this mitigation requirement. As such, your response should
clearly indicate your intentions with respect to how you propose to address
