Dear Mr. Bryant:
This Office has reviewed your application and has conducted a site visit and is placing your project on
hold until we receive the following additional information:
1). An overall site plan that shows avoidance and minimization for wetland impacts (i.e. lots # 10, 13, 14,
15, 16, 17 and 18 do not have buildable uplands and Lots # 20 and 21 will need to be combined to make a
buildable lot);
2). Restrictive covenants are to be placed on remaining wetlands. A sample deed notification is located on
our website at htt-o://h2o.enr.state.ne.us/ncwetlands/download.html.
3). It is the understanding of this Office that you also own the property across the access road and that it will
be a part of this project, you will need to include the entire project plan. This means the property on both
sides of the access road will need to be submitted as the part of the project;
4). This Office would also like to see a copy of the 401/404 Permit for the access road into the property. We
have no record for wetland fill for a road crossing and if this was done without a permit in violation of the
404/401 rules, this Office will need to resolve that before issuing other permits for the property.
Please respond within three weeks of the date of this letter by sending a copy of the information to Noelle
Lutheran and to Cyndi Karoly, 401 Wetlands Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-226, her phone
number is [phone]. If we do not hear from you within three weeks, we will assume that you no longer
want to pursue this project and we will consider the project as withdrawn. If you have any questions, please feel
