The proposed impacts result from the desire to construct a bulkhead and fill a portion of a jurisdictional wetland. The wetland area is located in a depression; and is basically a small pond bordered with forested wetlands. The-.pond bottorrl is covered with leaf and limb debris from surrounding and included trees, and the pond achieves at least 3 feet of depth in the portion proposed to be impacted. The wetland area impacted by the proposed bulkhead and fill contains approximately 4,750 square feet. The proposed impacts are associated with the preparation of Whispering Pines Subdivision lot 6, a single family residential lot, for construction of a single family residence. The subdivision is located on the north side of Wilcox Road, at the intersection with Old Airport Road, within a portion of the City of New Bern, in Craven County. The subdivision is bordered by the Evans Mill and Carolina Colours subdivisions. The 6 lots in the subdivision are aligned west to east, with Wilcox Road adjoining the south property lines. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Impact Justification (Avoidance and Minimization) for Tommy Batten Investments, LLC Lot 6 Whispering Pines Subdivision The impacts described in this application are associated with the preparation of Whispering Pines Subdivision lot 6, a single family residential lot, for construction of a single family residence. The subdivision is located on the north side of Wilcox Road, at the intersection with Old Airport Road, within a portion of the City of New Bern, in Craven County. The subdivision is bordered by the Evans Mill and Carolina Colours subdivisions. The b lots in the subdivision are aligned west to east, with Wilcox Road adjoining the south property lines. More specifically, the proposed impacts result from the desire to fill a portion of a jurisdictional wetland. The wetland area is located in a depression, and is basically a small pond bordered with forested wetlands. The pond bottom is covered with leaf and limb debris from surrounding and included trees, and the pond achieves at least 3 feet of depth in the portion proposed to be impacted. The City of New Bern zoning requirements for the subdivision dictate a minimum front setback of 35 feet from the right of way, side setbacks of 15 feet and rear setback of 25 feet from the property line. Applying minimum setbacks to lot 6 results in a building envelope that is approximately 105 feet wide and 165 feet deep. According to information contained on the Craven County GIS website, most of the existing residences near the project site exceed a base area of 2200 square feet. Comparing reported base areas with available building sketches indicates that base area reflects only the first level conditioned space and does not include floor space attributable to garages, front or rear porches or decks. When these other areas are added to the base area, the footprint of nearby residences often exceeds 3000 square feet. In order to accommodate a residence with proportions similar those in the surrounding developments, a building area 70 feet deep and 88 ft wide is proposed for the project site. The proposed site plan included with this application depicts a building area with those dimensions located 50 feet from the Wilcox Road right of way and 16 feet from the west side lot line. It is common for houses to be set back a distance of 50 feet or more from the right of way in the areas nearby the project site. There are approximately 7,990 square feet of wetlands present on the lot, of which, 5,440 square feet are within the lot's building envelope. The wetland portion of the building envelope is nearly triangular in shape, with the base situated along the eastern setback line. The wetland area extends a maximum of approximately 65 feet into the lot's building envelope from the east. The maximum intrusion occurs approximately 55 feet from the back of the lot's building envelope. An area of fill extending 9 feet east from the proposed building area will provide 5 feet of separation between the building area and the top of the fill slope, as well as space for a 4H:1 V slope that terminates at a proposed bulkhead. The bulkhead and fill also extend ;~`{o, approximately 60 feet north of the proposed building area to the northern wetland line. The wetland area impacted by the proposed bulkhead and fill contains approximately 4,750 square feet. A bulkhead is proposed along the east side of the impacted area. Using a bulkhead instead of sloped fill alone reduces the impacts to the wetland by truncating the fill footprint. Limited onsite investigation indicates that the pond is at least three feet deep within the area being impacted. Based upon an NCDENR minimum fill slope of 3H:1 V, the proposed bulkhead eliminates at least 9 feet, measured horizontally, of fill slope below the normal water level and an additional 3 feet of fill slope above the water level for each foot of bulkhead above the water surface. Assuming the bulkhead cap averages 1 foot above the normal pond water level, a minimum of 12 feet of slope, with an associated 1,500 square feet of impact is avoided. The bulkhead along the eastern edge of the impacted area is proposed to be straight, with its total length and height dictated by the span and existing elevations of the wetland. Based upon the lidar topography obtained from www.ncfloodmaps.com, and an onsite wetlands delineation, a bulkhead cap elevation of approximately 15 feet, NAVD `88 with a length of 135 feet is required to span the wetland as desired. A number of alternatives that would further minimized wetland impacts were considered. One group of alternatives included a variety of plans with the building area turned 90 degrees so that it was 70 feet wide and 88 feet deep. These alternatives had the potential to reduce the wetland impact by as much as 2,100 square feet, primarily by allowing the bulkhead alignment to be relocated 18 feet to the west. However, these alternatives required turning the residence 90 degrees toward one side lot line or the other. Turning the house to face the west forces realigning the building area eastward in order to provide sufficient space for ingress and egress in what becomes the "front" yard while preventing any construction within the mandatory setbacks. Shifting the building area eastward increases the impacted portion of the wetlands. Turning the house to face the east creates a "front" yard almost entirely comprised of wetland, which may have significant impacts on the value of the home. Neither case is desirable. Another group of alternatives focused on various bulkhead alignments. The bulkhead alignment capable of reducing the impacts by the largest amount is one that parallels the proposed building area. This alternative maintains a constant separation between, the building area and bulkhead for the length of the bulkhead, and results in a total impact of 1,950 square feet, a potential impact reduction of 2,800 square feet. However, this bulkhead alternative also presents the greatest potential for failure of the bulkhead (at the corner) and failure of the structural fill that forms the northeast corner of the proposed building area. This alternative was not chosen to avoid potential structural and associated life safety concerns. Other alternatives turned the bulkhead to the northwest at arbitrary points north of the proposed building area. A configuration with the turn located approximately 25 feet north of the building area resulted in a total impact of 4,075 square feet and represented a reduction of approximately 675 square feet from the proposed impact. The primary consideration for not choosing these alternatives is the desire to construct the bulkhead without turns, thereby eliminating the failure risks associated with the turn point, and simplifying construction. Another benefit of a straight bulkhead ~=~Ie alignment is that it creates a back yard of equal width, which is more attractive and useful. Additionally, installing a straight bulkhead reduces the potential for future permit requests by subsequent owners of the site in order to establish the same result. Either of two construction methods for the site work can prevent additional impacts beyond the proposed footprint of fill. Most effectively, a driven sheet-pile bulkhead can be constructed in its entirety from the fill side of the proposed alignment, followed by undercutting and fill behind the alignment. Once completed, the sheet-pile will physically separate the impacted and non-impacted areas, eliminating further impacts attributable to sedimentation created by cut and fill activities. Alternatively, although less effective, undercutting and fill placement may occur some distance behind the open end of an advancing sheet-pile bulkhead. In this method, the bulkhead is constructed in advance of fill placement, with placement of fill remaining only as close to the open end of the bulkhead wall as is necessary to construct the bulkhead. In either case, the goal is the prevention of any impact to the non-impacted area. Either method, if employed conscientiously, has the potential to eliminate the requirement for placement of erosion and sedimentation control devices such as silt fence in the wetland. P`le VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strm~ide html. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. If required, mitigation is proposed to be in the form of a conservation easement adjacent to a previously issued easement 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form. For additional information regarding the application process for the NCEEP, check the NCEEP website at http://h2o.enr.state.nc.us/wrp/index htm.
