Dear Mr. Hennessy and Ms. Allocoo:
On behalf of the Gaston County and the Gaston County Economic Development
Commission (GCEDC), S&ME, Inc. (S&ME) is submitting this response letter and
restoration plan in accordance with requirements of your June 11, 2010 Notice of
Violation (NOV) issued to the GCEDC in regard to the Southridge Parkway Extension
site. A copy of the NOV is included as an attachment to this letter. This response has
been developed in accordance with the Professional Services Subcontract Addendum 3
between S&ME and Woolpert Inc. for Woopert Project Number 6827 and in accordance
with S&ME Proposal No. 1357-23020-1OREV.
PROJECT BACKGROUND
The subject property consists of an approximately 55-acre tract located on the south side
of the Norfolk Southern railroad and east of East Maine Avenue between the Dole Foods
site and Gastonia Highway in Bessemer City, North Carolina. The property is currently
being developed for future industrial uses. The current development consists of roadway
construction along the southern portion of the property, site grading and clearing for
development along the northern part of the property, and grading associated with
stormwater retention features. The location of the project site is depicted by the Site
Vicinity Map (Figure 1) and the appropriate USGS Topographic Map (Figure 2).

Prior to development, jurisdictional delineation services were performed by S&ME on
this property and on an approximately 2-acre portion of land south of the property on
August 22, 2008 and March 5, 2009, respectively. During these delineations, a drainage
feature located within the western portion of the subject property was identified as a non-
jurisdictional stormwater channel. The same feature was also identified as non-
jurisdictional by STV / Ralph Whitehead Associates (STV/RWA) in a Preliminary
Jurisdictional Delineation report dated March 18, 2008.
Since the time of these reports, hydrological conditions have changed on site. Following
clearing of the site and initial grading associated with the road crossing and stormwater
retention features in early spring 2010, it came to the attention of the Project Coordinator
that the drainage feature was exhibiting relatively continuous flow. Following the
recommendation of the project erosion control inspector for North Carolina Department
of Environment and Natural Resources (NCDENR), the site was visited by Mike
Burkhard of NCDENR Division of Water Quality (DWQ), Surface Water Protection
section to determine the current jurisdictional status of the channel. During this site visit,
which was attended by representatives of GCEDC, Woolpert, S&ME, and STV/RWA,
Mr. Burkhard determined that, in its current condition, the channel would be considered
an intermittently flowing jurisdictional stream. Mr. Burkhard also identified the
jurisdictional origin of the channel. This jurisdictional call was later verified during a
June 3, 2010 site visit that included Alan Johnson of DWQ and Steve Chapin from the
U.S. Army Corp of Engineers (USACE). Following the initial field meeting with Mr.
Burkhard, all work on the site in the vicinity of the channel was halted.
On June 14, 2010, the channel was delineated in the field by David Homans of S&ME,
along with a small, jurisdictional wetland feature abutting the channel. The surveyed
location of these features, along with an approximation of the currently constructed
project components, can be seen in the attached Approximate Existing Site Conditions
Map (Figure 3). Photographs of site conditions at the time of this site visit are also
attached and their locations are depicted on Figure 3.
On June 15, 2010, GCEDC received the aforementioned NOV regarding impacts to this
channel. In total, an estimated 1,140 linear feet (If) were identified as having been
impacted. Specifically, the following impacts were observed:
An unauthorized 48-inch culvert of approximately 200 feet in length was installed
in the stream channel.
Sediment has impacted the channel due to land disturbing activities in and around
the stream.
Sediment depths of 2 to 6 inches were observed in the upper 600 feet of the
channel.
In order to address these unauthorized impacts, the NOV requested a response to the
following items:
An explanation of the plans to restore the pattern, profile, and dimension of the
impacted channel to allow for passage of water and aquatic life. (see Section IJ)

• An explanation of the plans to stabilize the stream banks to prevent further
sediment deposition in the channel (See Section II).
• An application for after-the-fact 404 / 401 permits (See Section III and attached
Pre-Construction Notification (PCN) form).
• A revision of the approved construction documents reflecting removal of
stormwater and sediment control BMPs from their current location in line with the
jurisdictional channel (See Section 1).
• A plan for mitigation of impacts at the site, should it be required (See Section III).
• A detailed schedule with dates of proposed actions, including dates when
restoration will begin and when the project will be complete (See Section Ii).
We have addressed each of the items identified above in the following numbered sections
of this response letter (response section are noted in parentheses above). Upon approval
from your office, Gaston County is prepared to undertake the necessary remedial
measures.
1. PROJECT RE-DESIGN
In order to address the concerns identified in the NOV and to minimize permanent
impacts to the channel to the extent practicable, the grading and site layout plan for the
project is being modified in the vicinity of the channel. Included in the proposed
modifications are the following:
The 48-inch culvert that allows the channel to pass under Southridge Parkway
Extension will be reduced at its downstream end from approximately 200 If in length
to 148 If. In order to allow for passage of aquatic organisms, the existing standpipe
apparatus at the upstream end of the culvert will be removed and converted into a
headwall so that the upstream restored channel can be tied to the culvert at the existing
invert elevation.
2. The in-line bio-retention basin and wet ponds that were partially constructed will be
removed and replaced off-line from the channel. The bio-retention basin (which the
channel was previously piped underneath) will be split into two basins, and the wet
ponds will be replaced with smaller ponds located to the east. The proposed
modifications will allow for an approximately 30-foot wide riparian buffer along the
restored channel between its outfall from the culvert under Southridge Parkway
Extension and its tie-in to the undisturbed channel to the south.
The settling basin that had been partially constructed to the north of Southridge
Parkway Extension will be graded to create a gentle slope which will allow overland
flow into the channel. The channel and adjacent riparian area will be restored within
the footprint of the former settling basin and tied in to the existing culvert at its current
invert elevation.
4. The original grading plan in the vicinity of the upper 6591f of channel will be
redesigned to tie in to existing contours within 30 feet of the existing channel
centerline in a manner that will allow for a 50-foot restored vegetated buffer around
the channel upstream of Southridge Parkway.

For an approximate depiction of the proposed design modifications, please see the
attached Restoration Plan Map (Figure 4). At the time of this letter, the full, finalized
grading modifications have not been completed by the project engineer (Woolpert). It is
estimated that these finalized plans will be available for your review at the date specified
in Table 3 (see section IV).
11. CHANNEL RESTORATION / STABILIZATION PLANS
Gaston County proposes a number of restoration measures to re-establish the pattern,
profile and dimension of the approximately 4961inear feet of stream channel that have
been graded or filled for the existing stormwater BMPs. In these areas, a restoration
channel pattern will be generated to match the l -foot contours taken from a May 5, 2008
pre-construction survey. Channel thalweg elevation will be designed to match the pre-
construction survey elevation to the extent practicable. In some instances, modifications
from the original profile will have to occur in order to transition to the existing culvert
invert elevations; these transitions will be spread over a length of channel to avoid steep
and potentially unstable channel gradients.
The hydrologic nature of this channel has proven to be somewhat in flux and no typical
undisturbed upstream or downstream reference reach js available. For these reasons, we
propose to establish typical cross-sectional dimensions for the restored channel based on
hydrologic modeling, rather than reference reach observation. These typical channel
cross-sections will be developed based on stable natural channel design principles and
parameters generated from HEC-RAS modeling of the watershed using applicable
regional curves. The restoration channel dimensions will be designed so that bankfull
profile will accommodate flows associated with the predicted 2-year recurrence peak
flow events.
For an approximate depiction of the areas where full channel restoration is proposed,
please see the attached Restoration Plan Map (Figure 4). At the time of this letter,
detailed typical cross-sectional profiles have not been completed by the project stream
restoration engineer (S&ME). It js estimated that these finalized plans will be available
for your review and incorporation into the re-designed grading plan at the date specified
in the attached schedule of dates (see section IV).
Channel banks within restored reaches will be matted from the top-of-bank to toe-of
slope with coir matting (or equivalent) and seeded with the riparian seed mix described in
Table 1. The seed mix will be applied from the banks to an area 10 feet upland of the
banks and at a rate of 40 pounds per acre (approximately 5 pounds per 5,000 square feet).
Affected areas will be overseeded with 40 pounds per acre of an equal mix of
(approximately 5 pounds per 5,000 square feet) of annual rye grain (Secale cereale),
Korean lespedeza (Kummerowia stipulacea) and millet (Setaria italica).

In the upper 659 if of the channel where disturbance of the banks and riparian area has
occurred but grading has not, a different restoration approach will be used in order to limit
further disturbance from construction equipment. Areas where active bank erosion is
occurring will be marked in the field, stabilized with coir matting, and seeded as described
above. Areas along this reach where the banks appear stable will be allowed to continue to
re-vegetate naturally with volunteer species.
Within this reach, there are a number of areas where excessive sediment deposition has
occurred due to upslope erosion and bank sloughing. In these areas, excessive sediment
will be removed from the channel thalweg in order to allow for more effective passage of
water. In these areas of excessive deposition, efforts will be made to approximate the
cross-sectional dimensions generated for downstream sections of the stream. Sediment
deposited in the floodplain that has started to stabilize into vegetated wetland areas will not
be disturbed.
A vegetated riparian buffer will be established along the stream channel in all restoration
areas. This buffer will extend 50 feet landward of the centerline of the channel upstream of
the Southridge Parkway Extension. Due to space constraints associated with installation of
the required storm basins, the riparian buffer will extend 30 feet from the channel
downstream of the road crossing. In cleared areas where volunteer vegetation has begun to
re-grow and restoration disturbance is to be kept to a minimum (Restoration Area A, Figure
4), native woody shrub species will be planted throughout the riparian buffer area in
accordance with the planting plan outlined in Table 2. Use of live stakes and bare-root
seedlings is not proposed due to high mortality rates associated with their planting outside
of the dormant season. Accordingly, use of small tree bands is proposed as an alternative.
In areas where earthmoving will occur within the riparian buffer zone (Restoration Area B,
Figure 4), the entire buffer zone will be seeded with 40 pounds per acre of an equal mix of
annual rye grain (Secale cereale), Korean lespedeza (Kummerowia stipulacea) and millet
(Selaria italica) in addition to being planted with the shrub species outline in Table 2.

Ill. PROJECT 401/404 PERMITTING
As identified previously in section I of this response, 148 If of jurisdictional intermittent
stream channel will be lost due to the culverted crossing under the Southridge Parkway
Extension. For this reason we are seeking authorization in accordance with North
Carolina Water Quality Certification (WQC) No. 3821 for these impacts. Attached is an
after-the-fact PCN Form outlining how the proposed project complies with the regulatory
considerations outlined in WQC No. 3821. According to telephone conversations
between Mr. Steve Chapin and Mr. David Homans, the USACE will not require after-the-
fact authorization under Nationwide Permit (NWP) No. 39 for this project so long as
points identified in the NOV are adequately addressed by this response letter. Should
federal 404 permitting be required, please consider the attached PCN Form as a request
for authorization under NWP 39.
The proposed modification to this project involves no permanent wetland impacts and
less than the 150 if of permanent jurisdictional stream loss that serves as the threshold for

requiring compensatory mitigation. Permanent impacts to the channel have been avoided
and minimized to the maximum extent practicable. Accordingly, we do not anticipate
that Gaston County will be required to provide additional compensatory mitigation
beyond the channel restoration activities described above in section II.
IV. SCHEDULE
As construction crews are currently mobilized on site, work associated with restoration
efforts can begin immediately following approval of this NOV response, completion of
the restoration plans, and approval of the required permit modifications. A detailed
proposed response schedule is provided in Table 3. Please note that this schedule is an
estimation and is contingent on modified plan approvals, planting material availability,
etc.
Following completion of restoration activities and site stabilization, the restored areas
will be photo documented. These photographs, along with a brief letter report, will be
provided to the NC DWQ and the USACE to verify that the restoration activities have
satisfactorily completed.

June 11, 2010
On May 11, 2010, Michael W. Burkhard of the Division of Water Quality (DWQ) conducted a stream determination call at
the South Ridge Parkway Extension project upon the request of staff of the Division of Land Resources (DLR).
After conducting a visual evaluation and completing the "NC Division of Water Quality Stream Identification Form",
Michael W. Burkhard determined that the water feature on this site is an intermittent stream and waters of the State.
Given the stream determination, the impacts observed at the site are a violation of state rules / regulations.
During the site visit, the following impacts were observed:
• Approximately 1,140 linear feet of intermittent stream has been impacted.
• Sediment has impacted the intermittent stream due to land disturbing activities in and around this stream.
Sediment depths of 2" to 6" were observed in the upper 600 feet of this stream reach.
• An unauthorized 48" culvert approximately 200' in length was installed in the creek channel.
As a result of the site inspection the following violations, detailed below, were noted:
Item I. 401 Water Quality Certification
The culvert installation is in violation of 15A NCAC 2h .0500 unauthorized installations of 200 linear feet of culvert. Water
Quality Certification 3687 allows only 40 linear feet of permanent stream impact with outwritten authorization.
Item 1. Removal of Use
The unauthorized disturbance to the intermittent creek and unpermitted creek crossing represents a violation of

If you wish any stream impacts to remain in place, you must contact the U.S. Army Corps of Engineers
(USACE) for information on the type(s) of permits required. Depending on the type of permits the USACE
requires, application for a 401 Water Quality Certification will also be required. Please note that sediment
impacts to streams can not be permitted.
Requested Response
This Office requests that you respond to this letter in writing within 30 days of receipt of this Notice. Your response should
be sent to both this Office at the letterhead address and to the attention of Mr. John Hennessy at the Wetlands and
Stormwater Branch, NPS Assistance and Compliance Oversight Unit, 1617 Mail Service Center, Raleigh, NC 27699-
1617. Your response should address the following items:
1. Provide an explanation of how you plan to restore the pattern, profile, and dimension of the impacted stream channel
to allow for low flow passage of water and aquatic life.
Provide an explanation of how you plan to stabilize the streambanks to prevent further sediment deposition within the
stream.
3. Submit an application for an after the fact 404 and 401 permits.
4. Have your engineer of record revise the approved construction documents reflecting the removal of all sediment
control devices and proposed stormwater and water quality ponds from being in line with this stream.
5. Mitigation may be required for the proposed impacts at the site. Please contact the Ecosystem Enhancement Program
for guidance in this matter.
6. Provide a detailed schedule with dates explaining when the restoration will begin and the projected completiorrdate. It
is strongly recommended that a person with experience in stream restoration and the States environmental program
be retained.
In addition, this Office is considering sending a recommendation for enforcement to the Director of the Division of Water
Quality regarding these issues and any future/continued violations that may be encountered. Your response to this
correspondence will be considered in this process. This office requires that the violations, as detailed above, be
abated immediately. These violations and any future violations are subject to a civil penalty assessment of up to

vegetation. Prior to the current project development, the site was largely made up of fallow pasture and early
successional areas.

Since the verification of the channel as a jurisdictional feature, the project has been entirely re-designed in order to minimize
permanent impacts to the channel and restore its condition. Re-design elements include: 1) reducing the culverted crossing
from 200 If in length to 148 If in length; 2) removal of all in-line stormwater basins upstream and downstream of the road and
re-designing of stormwater basins outside of the riparian buffer zone; 3) elimination of the proposed grading that was to occur
over the upper 659 If of the channel and redesigning of the grading plan to tie in to existing grades within the 50-foot riparian
buffer area; 4) application of natural channel design to areas where the channel had previously been graded for stormwater
features.
