I have reviewed the information and need clarification before proceeding with verifying the use of Nationwide Permit (NWP) 39 (http://saw-reg.usace.army.mil/NWP2017/2017NWP39.pdf). Please submit the requested information below (via e-mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider your application withdrawn and close the file: 1) Plan Sheet Nos. C1.0 and C1.1 (Wetland & Stream Impact Maps) and C1.2 (Culvert Impact Plan & Profile) report permanent wetland impacts of 505, 2073, 570, and 170 square feet (total of 3318 square feet or 0.076 acre) whereas the PCN reports permanent wetland impacts of 0.073 acre. Please confirm the permanent wetland impacts proposed, and update the impact and compensatory mitigation sections of the PCN and/or plan sheets accordingly; 2) Plan Sheet No. C1.2 (Culvert Impact Plan & Profile) shows the Limits of Disturbance extending into the stream channel beyond any proposed impacts. If any temporary impacts to streams are likely within these areas, please updated the PCN and plans accordingly and provide a temporary impact restoration plan; 3) Plan Sheet Nos. C0.0 through C2.2 included in the plan sheet package entitled "Environmental Impacts North Carolina National Guard McLeansville Regional Readiness Center" do not appear to be complete consistent with Plan Sheet Nos. C0.0 through C5.8 included in the plan sheet package entitled "Erosion Control Submittal North Carolina National Guard McLeansville Regional Readiness Center Early Site Package." Specifically, the proposed stream crossing in the latter plan sheet package appears to include an older stream crossing design with a longer rip rap pad, rather than the updated design of the former plan sheet package. In an effort to avoid future permit non-compliance, please ensure that all plan sheets associated with this project are consistent with the updated design as proposed for the requested NWP 39; 4) Given the existence of potentially suitable habitat for Schweinitz's sunflower and small whorled pogonia within the project action area, as well as recent USFWS concerns about these species in Guilford County, we will initiate informal consultation with the US Fish and Wildlife Service (USFWS).
