On August 2, 2010 the Division of Water Quality (Division) conducted a final inspection of the restored areas of your project
referenced above.
The Division determined that the work within the failed relocated stream channels as well as the removal of the temporary culverts
had been completed as approved. The Division will consider the violation closed at this time. The Division will also consider all
jurisdictional work approved by Certification #07-2160 completed.
Please note that approval of the stream restoration plan issued by this office on May 17, 2010 requires that "The permittee shall
visually monitor the restoration of Stream 1 monthly for 4 months and then quarterly for a total of 1 year of monitoring after
construction completion. You are still responsible for this monitoring and you must report any problems with the site to the Division's
attention immediately. In addition, all stormwater management requirements of Certification #07-2160 remain in effect.
Thank you for your attention to this matter. This Office is no longer considering sending a Recommendation for Enforcement to the
Director of the Division of Water Quality regarding these issues. Any future violations are subject to civil penalty assessment of up to
