The purpose of this project is to construct a new trail bridge over a native ford currently used by OHV, horse, and pedestrian trail users causing sedimentation of the creek. The new trail bridge will improve water quality by eliminating or limiting sediment, hydrocarbons, and animal wastes from entering the stream by keeping vehicles and trail users within the designated trail corridor. The project includes excavation, abutment construction, bridge installation, rip-rap placement, trail realignment and site restoration. This application is being made in order to comply with Section 404 of the Clean Water Act. Based on our review of the authorized Nationwide Permits (NWP) we believe this project is covered under NWP 14. To comply with PCN application instructions and NWP General Condition 19 (b) we are requesting Section 401 water quality certification for this project. Concurrent with this application, the PCN has been submitted to the US Army Corps of Engineers for Section 404 permit approval. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The project site is a low water creek crossing on the Dickey Bell Off-Road Vehicle Trail. This is a major crossing on a heavily utilized trail. At times the trail is not passable due to high water. The surrounding property is forested public land utilized mainly for recreational purposes such as hunting, fishing, equestrian trails and motorized trails. 3b. Explain the purpose of the proposed project: The purpose is to replace a sub-standard, at grade stream crossing (ford) with a new prefabricated steel bridge that will improve safety, limit or eliminate damage to resources and improve the productivity of this stretch of Dutch John Creek. The key component is the elimination of vehicle and horse travel within the stream. 3e. Describe the overall project in detail, including the type of equipment to be used: This project includes clearing and grubbing, placement of active erosion control measures, construction of new conrete abutments and the placement of a prefabricated steel stringer bridge 60 feet long by 12 feet wide, placement of large diameter (Class 5) riprap for scour protection at the southern abutment, realignment of the southern trail approach, site restoration, seeding and mulching of disturbed areas. Stream work will be limited to that required to construct the new bridge abutments, install the bridge, and place rip-rap. Equipment used to perform this work may include dump trucks, track mounted hydraulic excavators, mobile crane, dozer, concrete pump truck and concerte delivery trucks. 4. The installation of a bridge will eliminate off road vehicles, pedestrains, and horses from fording the stream. It will significantly reduce or eliminate the introduction of sediment, oil, fuel, animal wastes and invasive species from Dutch John creek at this location. Installation of rip-rap will prevent scour and stabilize slopes, revegetation of disturbed areas will stabilize the land and prevent soil movement. 1 b. Stream crossings by equipment will also be kept at a minimum. The trail will be closed to all users during the entire construction process. Erosion and sedimentation control practices including silt fences, check dams, temporary and permanent revegetation of all disturbed areas. Decision Memo for Dickey Bell Trail Bridge USDA, Forest Service National Forests in North Carolina &- Uwharrie National Forest Montgomery County, North Carolina February 2010 PROPOSED ACTION: It is my decision to install a bridge across Dutch John Creek on the Dickey Bell off-road vehicle (ORV) connector trail. This bridge would span approximately 60 feet in length and 14 feet in width, designed for single lane traffic. Concrete abutments would be installed on either side of the creek and approaches raised to meet clearance requirements. A more detailed description of the proposed action is available in the project file. Location of Proposed Action: The project area is located along the Dickey Bell ORV Trail (#96A), adjacent to Green Gap Road (Forest System Road # 6584). The project is approximately 15 miles northwest of the town of Troy. Environmental Protection: The following measures will be utilized to protect the environment and assure that any potential impacts are minimized: 1. Install erosion control devices to limit sedimentation into Dutch John Creek. 2. Notify residents of Green Gap Shores when construction is expected to begin and post signs to warn of equipment in roadway. PURPOSE AND NEED: The purpose of this project is to reduce ORV impacts to Dutch John Creek by removing vehicles from the water in an effort to protect water resources. This section of the Dickey Bell trail has been identified as an important ORV trail connector that carries significant amounts of vehicle traffic not suited for Forest Service system roads. Vehicles using the existing low water crossing are causing sedimentation of the creels and trail users are not staying within the trail corridor. Construction of a bridge at this site will improve water quality and keep vehicles within the designated trail corridor. The American Recovery and Reinvestment Act has identified. this project for funding this year, thus the need to move forward with a project decision at this time. Dickey Bell Trail Bridge Decision Memo Page 1 of 4 REASONS FOR THE DECISION: I am making this decision to install a bridge at Dutch John Creek on the Dickey Bell ORV Trail to address water quality issues and provide for trail user safety. This action will continue to provide reasonable trail access to the Badin Lake ORV Trail System. REASONS FOR CATEGORICALLY EXCLUDING THE PROPOSED ACTION: An environmental analysis was conducted for this proposed action. As a result of that analysis, a determination has been made that the proposal is in a category of actions that are excluded from further documentation in an Environmental Assessment or an Environmental Impact Statement. That category of exclusion was established by the Chief of the Forest Service and is documented in the Federal Register, Volume 57, Number 182, page 43209, section 31.2 (1), Construction and reconstruction of trails. This decision meets this category since the project involves maintenance work to an existing trail system and construction of a trail bridge. FINDINGS OF NO EXTRAORDINARY CIRCUMSTANCES: An Interdisciplinary Team was formed from resource specialists on the National Forest in North Carolina. That team consisted of a botanist, archaeologist, wildlife biologist, engineer, and recreation specialist. These resource specialists did not identify any significant issues during project review, and mitigation measures included as part of the project proposal addressed all other concerns. Their reports are available in the project record, which is located in the District office, and available upon request. It was also determined through the environmental analysis that there were no extraordinary circumstances or conditions, as listed in the Federal Register (Vol. 67, Num. 164, pg 54622, section 30.3 (2)) related to this proposal that might cause the action to have significant effects. Specifically, this determination is based upon the absence, among others, of adverse effects on the following: Federally listed threatened or endangered species or designated critical habitat, species proposed for federal listing or proposed critical habitat, or Forest Service sensitive species. A Biological Evaluation was prepared for both terrestrial and aquatic animal species and for plant species. There are no threatened, endangered, proposed, or regionally sensitive plant or animal species identified in the project area, nor has the project area been identified as critical habitat. It is determined that construction of the Dickey Bell ORV trail bridge will have no direct, indirect or cumulative effects on any PETS species or regional forester's sensitive species. 2. Flood plains, wetlands, or municipal watersheds. The project is within a flood plain, but not within wetlands, or a municipal watershed. However, there are no adverse impacts to the floodplain by construction of the trail bridge. Dickey Bell Trail Bridge Decision Memo Page 2 of 4 3. Congressionally designated areas, such as wilderness, wilderness study areas, or National Recreation Areas. This project is not within a wilderness, wilderness study area or National Recreation Area. The closest wilderness area, the Birkhead Wilderness, is located approximately 15 miles to the northeast of the project area. 4. Inventoried roadless areas. This project is not within any inventoried roadless area. There are no inventoried roadless areas on the Uwharrie National Forest. 5. Research Natural Areas. This project is not within a Research Natural Area. There are no Research Natural Areas on the Uwharrie National Forest. 6 American Indians and Alaska Native religious or cultural sites. Based on past environmental analysis for the project area and recent consultations with American Indian tribal councils, there are no known uses of this area for religious or cultural purposes. 7. Archaeological sites, or historic properties or areas. An Archaeological Survey was completed and the conclusion from this survey stated there would be no effect to heritage resources. A non-significant class III site was located during the surveys, but this site has been cleared for construction work. SCOPING AND PUBLIC INVOLVEMENT: This proposal was developed during internal discussions among resource specialists who were assigned to the project. Interdisciplinary Team members visited the project area and identified resource issues and mitigation measures that would minimize effects. Recommendations from those specialists have been included in the project design. In addition to internal discussions, a scoping letter was mailed to 44 residents of Green Gap Shores on December 18, 2009, requesting comment. No comments were received from the public during scoping. FINDINGS REQUIRED BY OTHER LAWS AND REGULATIONS: All management practices and activities of the proposed action are consistent with management direction, including standards and guidelines, in the Uwharrie National Forest Land and Resource Management Plan (1986), which was developed in accordance with the National Forest Management Act of 1976,16 USC 1604(1) and 36 CFR 219.10(e). This project is also consistent with the National Environmental Policy Act (1969), the Endangered Species Act (1973), the Federal Clean Water Act (1972), and the Clean Air Act (1977). This action does not result in Environmental Justice issues, as defined in Executive Order 12898.
