Recently however, we have been working with your offices on a mitigation plan proposing preservation to offset some of these compensatory mitigation fees. James Lastinger of the US Army Corps of Engineers (USACE) and Eric Kulz of the NC Division of Water Quality (NCDWQ) have visited the site and concur with our proposed methodology. As such, I have summarized below the revised compensatory mitigation plan for your review and anticipated approvals. In addition, we have provided a sketch map that shows the approximate locations and length/areas of the perennial and intermittent stream and wetland preservation. The property owner is currently surveying all streams and wetland features on the site and at a later date we will provide the final survey and recordation of deed restrictions for your files. As discussed, we anticipate that you will make receipt of the survey and recording of the deed restriction a condition of you approval. The Franklin County HUB project is proposing permanent impacts to 238 linear feet of important/perennial stream, 120 linear feet of unimportant/intermittent stream and 0.167 acres of jurisdictional wetlands (permanent + temporary). The USACE is requiring compensatory mitigation at a 2:1 ratio for 238 linear feet of important stream and 0.167 acres of wetlands. The NCDWQ is requiring compensatory mitigation at a 1:1 ratio for 120 linear feet of intermittent stream. In order to meet the above compensatory mitigation requirements, the applicant is proposing an In-Lieu Fee payment to the NCEEP for 238 linear feet of stream, the applicant has a valid NCEEP Acceptance letter for this In-Lieu fee (see attached). In addition, the applicant is proposing preservation of approximately 1,905 linear feet of important/perennial stream, 1.67acres of wetlands and the adjacent riparian areas to the extent of the eastern and western property boundaries to meet the additional mitigation requirements. Based on site visits with James Lastinger and Eric Kulz, they have both agreed to a 5:1 preservation ratio for the streams due to the quality of the system and the owners willingness to place a deed restriction on the entire property not just the first 50 feet adjacent to the streams. The only exception would be a 40 foot wide corridor as approximately shown on the attached exhibit, this corridor will be shown on the future preservation survey. It is unknown if a greenway will ever be built and unlikely that a utility line will ever be installed within the easement but all involved believed it was better to indicate this possibility now rather than to possibly have to modify the restrictions in the future. The approximately shown easemenbcorridor would be a 25 foot wide permanent easement with 15 foot of additional width to be used only for a temporary construction easement. This preservation area will be protected by a recorded Declaration of Restrictions. The owner's intention is that the remainder of the streams and wetlands shown on the exhibit will be used for similar preservation mitigation at some time in the future and has no objection to that understanding being documented in your approval letters. The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept payment for impacts associated with the above referenced project. Please note that this decision does not assure that the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. You must also comWy with all other state, federal or local government permits regulations or This acceptance is valid for nine months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net. Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the following table. If the regulatory agencies require mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional mitigation, the applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The mitigation will be performed in accordance with the Memorandum of Understanding between the N.C. Department of Environment and Natural Resources and the U.S. Army Corps of Engineers dated November 4, 1998.
