Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. Describe the existing conditions on the site and general land use in the vicinity of the project at the time of this application: Page 2 of 11 Highland Village Apartments are currently under construction. The bio-retention area (Bioretention Area 3) is currently being used as an erosion and sediment control device (see attached photos) and will be converted to a bio-retention area once construction is complete. Construction is complete and residents are living within the buildings of The Commons at Highland Village and Highland Manor. The remainder of Highland Village is currently under varying stages of grading and construction. The general land uses in the vicinity of the project include vacant land (zoned for commercial and multifamily residential), existing commercial buildings and existing residential homes. 10. Describe the overall project in detail, including the type of equipment to be used: Highland Village is a multi-use residential development including apartment buildings, condominiums and townhomes. The only parcel containing jurisdictional waters or buffers is the Highland Village Apartments parcel. The project includes the completion of construction of the Highland Village Apartments and associated bio-retention area. Heavy equipment typical for the site preparation and construction of a residential apartment building complex have and will be used. 11. Explain the purpose of the proposed work: The basic project purpose is the completion of construction of the Highland Village Apartment complex. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. S&EC was contracted during the project planning stages of the development to conduct a Jurisdictional Determination for the presence of Waters of the US regulated under Section 404 & 401 of the Clean Water Act and to identify surface waters subject to the Neuse River Buffers. Ms Amanda Jones of the USACE verified the Jurisdictional Determination (JD) and approved the JD map in July 2001 (see attached JD and map). Mr. Charles Brown of the DWQ verified surface waters subject to the Neuse Buffer Rule in March 2002 (see attached letter). The only surface water determined to be subject to the buffers within the Highland Village development was approximately 65 feet of an intermittent stream located near the eastern property boundary (previously depicted with flags 100 to 103. The stream flowed out of an approximately 110 foot long 12" diameter pipe that drained a wetland Page 3 of I 1 area north of the pipe (see attached JD map). The stream flows south for approximately 65 feet and then enters another pipe near the eastern property line. While with the DWQ, I confirmed Mr. Brown's determination in May 2002 see attached letter). The Highland Village Apartments site plan was revised in late 2002 and early 2003 to avoid and minimize impacts to the wetlands streams and buffers. A large retaining wall was used along the entrance road (Winfred Dell Lane) and on the west side of the bio-retention area to minimize and avoid impacts to these resources. However, 3 3,928 square feet or approximately 0.09 acres of wetlands were proposed to be impacted by the revised site plan. The applicant impacted the 0.09 acres of wetlands in 2005 for the construction of Falcone Drive Extension and the Highland Village Apartment complex with the understanding that this activity did not require prior notification to or written authorization from the USACE under Nationwide Permit No 39 (NWP 39 or DWQ under General Water Quality Certification No. 3402 because these impacts were less than l/10 acre. Condition I of NWP 39 requires; "For discharges causing the loss of 11/101 acre or less of waters of the United States the nermittee must submit a report within 30 days of completion of the work-, to the District Engineer that contains the following information: (1) The name, address and telephone number of the nermittee • (2) The location of the work: (3) A description of the work: (4) The type and acreage o the loss of waters of the United States (e.g.. 1121 acre of emergent wetlands): and (5)The type and acreage of any compensatory mitigation used to offset the loss o waters of the United States (e.g. 11121 acre of emergent wetlands created on-site)." While construction of the apartment complex and bio-retention area is not yet complete, the discharge of fill to waters has already occurred and as such the applicant is copying the USACE on this request to act as their report to fulfill their obligations required under Condition I of NWP39. The applicant believed that the removal of the existing 110 foot long, 12" diameter pipe and replacement with a new bypass pipe and discharge pipe from the bio-retention area would be considered an "exempt" activity under the Neuse Buffer Rule as an "existing use". As such, the applicant replaced the existing 110 foot long 12" diameter pipe with the new bypass nine and bio-retention area discharge pipe The applicant later contacted S&EC regarding this activity and S&EC informed the applicant that they believed the activity was not "exempt" from the Neuse Buffer Rule. S&EC believes that the activity could be considered "allowable" as a new stormwater conveyance through the buffer provided that a stormwater management facility is installed to control nitrogen and attenuate flow before the conveyance discharges through the riparian buffer. As such S&EC recommended that the applicant request this "after-the-fact" no practical alternatives review and Authorization Certificate. V. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. Page 4 of I I There are no future pennit requests anticipated for this project. VI. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. Each impact must be listed separately in the tables below (e.g., culvert installation should be listed separately from riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts, permanent and temporary, must be listed, and must be labeled and clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) should be shown on a delineation map, whether or not impacts are proposed to these systems. Wetland and stream evaluation and delineation forms should be included as appropriate. Photographs may be included at the applicant's discretion. If this proposed impact is strictly for wetland or stream mitigation, list and describe the impact in Section VIII below. If additional space is needed for listing or description, please attach a separate sheet. 1. Provide a written description of the proposed impacts: Approximately 0.09 acres of wetlands have been impacted by the proposed project. The proposed project consists of the extension of Falcone Parkway Extension and the construction of the Highland Village Apartment complex (Please note that the bio-retention area was not located in an area that previously contained wetlands or other jurisdictional waters.) This request is only for the "after-the-fact" impacts to the Neuse River Buffers. The applicant is not requesting authorization for the 0.09 acres of wetland impacts, but is simply reporting these impacts to the Corps by copy of this buffer request. 2. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. As stated within the Prior Project History section of this application the development plans for Highland Village were revised to avoid and minimize impacts to jurisdictional waters and buffers as much as practical Wetland impacts have been reduced below \1 /10\ acre and buffer impacts have been avoided except for those associated with the replacement of the pre-existing 110 foot long 12" diameter pipe with the new bypass pipe and bio-retention area discharge pipe. Retaining walls were inco!Vorated into the design to avoid impacts to wetlands. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable Page 7 of 11 mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://12o.enr.state.nc.us/ncwetiands/stnmgidc.litm]. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. It is not anticipated that mitigation will be required for the 0.09 acres of wetland impacts that have already occurred because the impacts are less than 1/10 acre. Also, it is not anticipated that mitigation will be required for the buffer impacts in that the activity that caused these impacts is believed to be "allowable" and as such should not require mitigation. It should also be noted fill slopes were kept outside of Zone l and the only impact to the buffers occurred to areas previously impacted by the pre-existing 110 foot long 12" diameter pipe. If it is determined that mitigation is required then the applicant proposes payment into the NC Ecosystem Enhancement Program (EEP). 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form. For additional information regarding the application process for the NCEEP, check the NCEEP website at http://h2o.cnr.state.nc.us/wM/index.htm. XI. Stormwater (required by DWQ) Describe impervious acreage (existing and proposed) versus total acreage on the site. Discuss stormwater controls proposed in order to protect surface waters and wetlands downstream from the property. If percent impervious surface exceeds 20%, please provide calculations demonstrating total proposed impervious level. The Highland Villas Apartment complex exceeds 30% impervious surface. While Condition No 4 of GC3402 does not apply because written concurrence from the DWQ is not required to use GC3402 bio-retention areas have been incorporated into the design of the development to manage and treat stormwater runoff from the development and to comply with Cary's Neuse River Stormwater requirements. Please note that a DWQ approved stormwater management plan as described within Condition No 4 of GC3402 should not be required for this development because written concurrence to use GC3402 is not required However DWQ review of Bioretention Area 3 is anticipated as it involves the "allowable" use of directly discharging through the buffer by means of a new stormwater conveyance Stormwater management plans calculations and a completed DWQ Worksheet for Bioretention Area 3 have been provided for your review. All stormwater runoff from impervious surfaces associated with the Highland Village Apartment complex will be treated by Bioretention Area 3 prior to discharge through the buffer to the stream Bioretention Area 3 meets the design requirements of the NC DENR Stormwater BMP Manual. Bioretention Area 3 will also treat stormwater runoff from other parcels within the Highland Village development It is12art of an overall stormwater management plan for the Highland Village development that includes three (3) bioretention areas. XII. Sewage Disposal (required by DWQ) Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility. Highland Village connects to Cary's sanitary sewer system. Cary will ensure that this connection does not exceed the available capacity of their treatment facility. XIII. This on-site determination was conducted to review the determination made by Mr. Charles Brown of the DWQ Raleigh Regional Office (RRO) staff that was provided to you within a letter dated March 26, 2002. As a result of our on- site detennination the Division of Water Quality (DWQ) has determined that the drainage feature between flags 103 and 100 (approximately sixty-five (65) feet long, located between two pipes) as approximated on the attached "Preliminary Wetland Approximation" dated 5/30/01 stamped and initialed by DWQ staff on 5/2/02 is an intermittent stream. Therefore, the DWQ agrees with Mr. Brown's original determination that the feature is an intermttent stream subject to the Neuse River Buffer Rules (North Carolina Adnunistrative Code T15A:02B .0233). No other surface waters subject to the Neuse River Buffer Rules were found to exist upstream of flag 103. The DWQ staff recognizes that the North Carolina Piedmont (as well as the rest of the State) is currently experiencing drought conditions and are willing to re- evaluate the stream during a period of normal rainfall at your written request. The property owner is required to maintain 50-foot buffers along this stream pursuant to the buffer rules (15A NCAC 2B .0233). Ms. Jennifer Burdette of your company asked DWQ staff whether it would be possibly to construct an extended detention stonnwater wetland or wet detention basin within the intermittent stream and buffers. DWQ staff informed her that this activity would be reviewed as a "stormwater management pond" under the buffer rules (15A NCAC 2B .0233). DWQ staff informed her that a "wet detention basin" would require that a 50-foot buffer be established adjacent to the pond. If no buffer was proposed, then DWQ could still approve that activity but it would require mitigation for the buffer impacts. DWQ staff informed her that an extended detention storntwater wetland would not be required to have a buffer established adjacent to it and will not require mitigation for the buffer impacts. DWQ staff informed her that both of these activities will require a no practical alternatives determination by and approval from the DWQ prior to construction. DWQ staff informed her that any impacts to the stream will need to comply with tile 40 1 and 404 wetland regulations. DWQ staff informed her that the stream would not require stream mitigation impacts under the DWQ 401 program. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the State.
