Dear Mr. Brown and Ms. Yankura,
South Market, LLC received a United States Army Corps of Engineers (USACE) 404 permit
(USACE Action ID No. SAW-2014-00219) on October 22, 2014 and a North Carolina Division
of Water Resources 401 Certification (DWR #14-0471) on October 3, 2014 authorizing impacts
to 0.68 acre of wetland and 0.11 acre of open water. To mitigate for these impacts, South Market,
LLC was required to create 0.75 acre of wetland at the project site located in Henderson County,
North Carolina. A site visit was conducted with Mr. David Brown and Alea Tuttle on November
4, 2020, during which it was observed that the site has met all vegetation and hydrology success
criteria through monitoring year 5. The South Market, LLC Conceptual Mitigation Plan (March
2014) provides for the Permittee to request termination of monitoring after year five if the site is
meeting the success criteria and no concerns have been identified. South Market LLC is
requesting early close out due to meeting both vegetation and hydrology success criteria in
Monitoring Year 5 of 7.
